The Constitutional Court's decision has come out in favour of Shpend Ahmeti, where it is decided he remains head of the Pristina municipality and will not have elections in Pristina, as his opponent from LDK], Arban Abashi, had requested.
The Supreme Court's “Colegy has rejected the complaint of the Democratic League of Kosovo (LDK), the branch in Pristina, submitted against the PZAP decision”, reported in the Constitutional Court's act.
In the Constitutional Act, the court said, unanimously, refused to impose the request for hearing hearings in advance, because it did not consider there was any uncertainty about “evidence or law”.
The court found that the documents included in the motion are sufficient to decide the merits of this case.
Arban Abrashi and the Democratic League of Kosovo claimed that the Supreme Court, but also the PZAP, in the procedures developed for examining their complaints and appeals, have failed to provide judicial protection of their guaranteed rights with Constitutions and, as a result, the decisions of these public authorities have resulted in violations of their electoral rights and guaranteed participation with Article 45 [The Electoral Rights and Submission] of the Constitution.
The former mayor of Pristina by the Democratic League of Kosovo, Arban Abashi, had led to the Constitutional in May last year the election of Shpend Ahmeti to head of the capital, which concerns the assessment of the second round of runoff in Pristina in 2017.
Shpend Ahmeti had emerged as the winner of the Pristina chairmanial elections, receiving the second mandate to lead the capital.
Ahmeti won these elections after counting conditional votes, by mail and persons with disabilities.
