ZKA: Seven road projects were launched without construction permits, violation of legal requirements

The annual report by the National Audition Office (ZKA) has found irregularities in the realisation of road projects, consisting that in seven cases contracts for construction, rehabilitation, expansion and restructuring of regional and national roads have been signed during 2025 without pre-equivocal permits.
According to the report, the Ministry of Environment and Spatial Planning has legal competence for issuing permits for category construction III, which includes projects of national interest and high risk. Similarly, the legislation stipulates that construction permits for state-run roads of the first and second order must be issued before the work starts.
Auditors have concluded that the projects have been launched without meeting this legal condition, including investments of considerable financial value.
The ECA estimates that cases have occurred as a result of failing to comply with legal requirements for issuing construction permits and lack of functional internal control mechanisms for their treatment and release.
“During auditing, through revision of procurement procedures and signed contracts, has been found that in seven cases contracts for construction, rehabilitation, expansion and restructuring of regional and national roads have been signed during 2025 without pre-equivocal permits from the ministry. These cases include investments of considerable financial value and show a repeat practice of starting projects without meeting the necessary legal conditions.
The cases have occurred as a result of the Ministry's failure to comply with legal requirements for issuing construction permits, as well as the lack of a functional mechanism and effective internal controls for handling and issuing these permits. This has led the projects to be realised without being equipped with construction permits systematically”, written in the ZKA report.
The report stresses that implementation of construction projects without construction permits poses violations of the law, increases the risk of improper implementation of projects, and can bring legal and financial consequences. Also, lack of permits could cause construction cuts, delays in project implementation, cost increases, and impact the safety and quality of the work.

In its recommendation, the ZKA requires that the Minister of Infrastructure and Transport ensure that the process for issuing construction permits in accordance with legal requirements, establishing clear mechanisms and effective controls guarantee that no project begins without construction permits.
