Otherwise, the Constitutional Court in Prizren, in July 2019, had taken a plea, with which the accused Shala had convicted him of criminal crimes against the civilian population, condemning him to 14 years in prison.
Following the defence complaint, the Court of Appeals had amended the first degree of judgment, bringing Shala's sentence to 10 years in prison.
The request for protection of legitimacy in the Supreme Court had submitted the defender, lawyer Natal Bulaaj.
The Supreme Court, in May 2020, had turned the case into a first - degree retrial.
Former Commander The KLA, known as commander “Red Mola”, is charged by the Special Prosecutor of the Republic of Kosovo (PSRK) for killing a civilian during the recent war in Kosovo.
Shala charged by P SRK that during wartime in Kosovo, on June 26, 1998, acting as a member of the Kosovo Liberation Army (UÇK), along with several other unidentified members, have taken out of his home, the victim Haxhi Pertesh.
Always according to the indictment, Remzi Shala, who was the only one with no mask on his head, along with 5-6 other KLA members disguised, under suspicion that the deceased was a collaborator of Serbian forces, have gone to the village of Dudhl and the same have been sent to an unknown location.
The victim's son, Agron Pertesh, is said to have seen them leave, along with his father, towards the village of Grejqevc, and after several days the dead man's lifeless body was found near the road, near the centre of the village of Duhdhl.
