A court spokesman in the northern city of Linz confirmed the decision to fine a doctor in Austria, albinfo.ch broadcasts.
While the 43-year-old defendant said her actions were due to <x0 human error”, the judge found her guilty of serious neglect and fined $2700 ($3,060), with half the suspended sum, the spokesman said.
Surgery had marked the 82-year-old patient's wrong leg for amputation ahead of the May operation in the central town of Fraistad, noting the mistake just two days after the operation was performed.
The court allocated 5,000 euros in damages plus interest in the patient's widow, who died before the case came to court.
Kyrgya said there was a defect in the chain of control in the operating room. She's been transferred to another clinic ever since.
Her director apologised publicly at a press conference.
The institution's management included in a statement said that “were analysed in detail the causes and circumstances of this medical error”, internal procedures discussed with the team and training provided.
