The renowned lawyer, Dastid Pallaska, says some steps must be followed by political protagonists, so that they can prove to us that state stability is not at risk.
Here's Mr. Polaska:
The stability and functionality of a state is not necessarily influenced by the nature of problems and crises that can be presented from time to time.
Rather, a state's stability and functionality are measured only on the basis of the state's capacity to solve the problems and crises it faces.
After a period of extreme irresponsability of political protagonists, today we are at a time when the stability and functionality of our state are tested.
If the goal of political protagonists is not to stir up unrest and create parallels of power that would prove the theories of our opponents inside and outside that Kosovo is a failed state, the next steps are necessary for de-exception of the situation and the return of normality to the country:
- The president must publish letter exchange with the LDK about the possibility of a mandate proposal for government creation by a coalition led by this political party.
- If the LDK drafts a new parliamentary majority and sends the president the name of the mandate, the president should publish this proposal, as well as his eventual decree for the mandate to establish the government before the decree is sent to the Assembly for review and vote.
- The House of Government selection hearing should not be established earlier than three days from the day the president's decree was handed over to the Assembly.
- Within this three-day term, any authorised party, which claims the president's decree is contrary to the Constitution, will probably send the president's decree for assessment to the Constitutional Court and request the suspension of the decree until the constitutional court's merit settlement.
- After presenting the issue of resolution to the Constitutional Court, all sides should also publicly pledge that the constitutional evaluation procedure by the Constitutional Court is the only way to resolve the issue and that they will respect the Constitutional Court's decision.
- In addition to respecting the Constitutional Court's decision, all sides must publicly appeal against riots or violent protests before and/or after the Constitutional Court's decision.
- The Constitutional Court must, before holding the Assembly session, suspend implementation of the president's decree for the appointment of a mandate for the establishment of government until the issue's merits are decided.
- Following the Constitutional Court's decision on this matter, all parties must publicly declare that despite the eventual discontent of the Constitutional Court will respect and observe.
From the point of view that each crisis has another chance, I wish that this crisis would serve as an opportunity to prove itself and everyone else that we deserve the state we have.
