The 22-year-old Kosovar sentenced to life imprisonment for causing a death after a fatal car race in Moers challenges the act of prejudice.
The Federal Court of Justice (BGH) should review the Regional Court's decision in Kleve, writes the German News Agency, DPA.
The defendant has filed a complaint against the indictment, a spokesman for the court mentioned Friday said, broadcasts albinfo.ch. The next contester, sentenced to 3 years and 9 months in prison, has also filed complaints.
The court had made its decision on the case Monday. It has concluded that 22-year-old Kosovo had been running a single-person car race, citizens of Germany of the same age. The race was held in a residential area in Moers in April 2019.
Kosovo's car had crashed into an innocent woman's car, which had nothing to do with racers, broadcasts albinfo.ch. The 43 - year - old woman had died three days later from her injuries.
According to expertise, the car, the cause of the accident, had traveled up to 167 miles per hour during the race within the residential area.
The other driver, a German citizen, was sentenced to three years and nine months by the court for participating in a banned automotive race that has resulted in death. The Public Prosecutor's Office in Kleve and the lawyer of the damaged party do not want to file complaints.
