The request for dropping the indictment and rejecting evidence was rejected by the court's chairman, Judge Naser Foniqi, who declared defence objections have offered insufficient evidence in order to drop the prosecution's indictment.
“has been rejected as unequivocal on defence requirements, dated 28,12.2017, against the indictment, because insufficient evidence has been offered to cast the indictment”, Judge Foniqi has declared.
Presequently, prosecutor Duline Hamiti asked the court to refuse objections filed by the accused and his defender, since, according to her, no evidence has been presented.
We consider that the request for dropping the indictment and rejecting evidence is not based on any single evidence, we consider that the indictment filed by the prosecution is based on sufficient and legal evidence that we have proposed by indictment, which will be administered during the trial. We propose to the court that these objections be rejected as unbased”, prosecutor Hamiti said.
Judge Foniqi said that if the decision to cast the indictment wins the formal form, and the trial will be held on March 2, 2018, at 13:10.
On the basis of the indictment, Qazim Candman, during which time he exercised the position of deputy minister at the Ministry of Labour and Social Goods, exploiting this position has exceeded his legal competencies in order to bring about a wealth of self-profit.
The prosecution claims that Mrmerman, during the period June 2015 until January 2016, from the official bank card destined for trips abroad, has issued a total of 12,363.40 euros without approval for official travel.
Always according to the indictment, from the total amount that had been withdrawn, MPMS, the Canton has returned 7,504.51 euros, while the actual damage to MPMS amounts to 4.858.89 euros.
