The first murder of a year in Podujevo, the witness says the father killed the boy for two residences in Fushe-Kosovo

The witness said that a week before the critical day accused Naim Smajli had appeared in the police as well as the late E.S because they had property problems. According to him, the police had advised them to refrain from harmful acts, reports “Justice Trust”.

These statements by witness Shefqet Smajli, who is the son of Naim Smajli's uncle, have been given at the Constitutional Court in Pristina on Thursday, where judicial review has been held.

Shefqet Smajli has even said that there had been property problems with the accused, there had been a civil trial, but that the accused had never appeared in court.

The Witness has shown that on the critical day, he had been called by his wife after hearing shots at the site where the deceased was cutting grass with a tractor.

Shefqet Smajli said that at the scene he saw tin shells and that the deceased E.S. was lying on the ground near the tractor.

The Witness has said that he does not remember when they had good reports with accused Naim Smajli.

The witness Smajli also explained that accused Naim Smajli does not have good reports even with neighbours and other family members mainly for property reasons.

After giving his testimony to the court's head, Judge Allton Murseli asked the parties for new witness hearing proposals where prosecutor Limani said there are no new proposals, meanwhile, lawyer Aslan proposed witnesses Gzim Gashi, Shukrije Ssmajlin, forensic expert and forensic psychiatrist expert.

But the court rejected the Council attorney's proposal for the hearing of witnesses Gashi and Smajli as they were not eyewitnesses on the critical day, and the hearing of forensics expert was refused because the expertise is understandable.

Meanwhile, the proposal for the hearing of forensic-force experts was approved.

The next session for this matter was scheduled on July 26th of this year, where forensic psychistry expert named after the paperwork is expected to be heard.

Naim Smajli is being charged by the Constitutional Prosecutor for Criminal Work “severe murder” against E.S. where the late man was a son of the accused, as well as for criminal work “held ownership, control or unauthorized possession of weapons”

Unlike the indictment set by Pristina Foundation Prosecutor 22 December 2022 N.S. around five o'clock in the village of Bajcina, the Podujevo municipality because of property disputes over property issues deliberately deprived his deceased son of life now.

The accused Smajli, according to the indictment, has fired his late son E.S.

With these actions, N.S. is charged by the prosecution for criminal work “serious murder” by Article 173 paragraph 1 points 1.3 of the Republic of Kosovo Penal Code.(KPRK)

Always in accordance with the N.S. indictment from the indefinite date until June 13th of 2022 has held the weapon of the type “automatic rifle” contrary to the law, an explosive tool, hand grenade, and, with their possession, the accused Smajli also carried out the criminal work “kept in Property, unauthorized control or possession of weapons<3> from Article 366 paragraph 1 of KPR.
