Lawyer with legal explanation: The ban on wearing headscarves in schools is in harmony with the Constitution

Lawyer Virtue Ibrahimaga has come up with a legal stance concerning the established Administrative Guideship debate on the issue of carrying religious cover to school facilities. Ibrahimaga says that the article of Administrative Guidance, 2014, is in harmony with the Constitution of the Republic of Kosovo, as it further provides clarification on what this code specifys more specifically about wearing the headscarf.

” NR 06/2014 is in line with the Constitution of Kosovo.

Article 1.13 of Administrative Guide. 06/2014 is in harmony with the constitution, and its abolition would have only one consistency and that encouraging parents with fanatic religious convictions to cover their children.

The guidance in question is the code of courtesy for elementary and secondary schools - minors.

Higher education has been excluded through the Constitutional Court's decision on the matter in question. This code aside from stopping to wear a religious uniform has other stops in the garment.

Our education system is based on the values of a secular, democratic, freedom, promoting gender equality and respect for human rights. Citizens themselves decide their rights after they reach adulthood. Until then, the state is tasked with educating children in the spirit of our constitutional social order; tolerance; the liberation of religious divisions; gender equality; the status of democratic social order; and the national cultural spirit.

The female cover is the rule of maturity and has nothing to do with our culture and the values of our social order assigned to Article 7 and 8 of the constitution.

If the initiative is aimed at protecting human rights, then the initiative has failed since its goal. This initiative does not promote human rights. They don't protect children's rights, if the parent is allowed to impose his/or her infant child with covering/sham.

This initiative can only protect the “direct parents' ” to cover their daughters, the rights of groups promoting female discrimination, or the rights of various organisations to promote the culture of eastern countries in Kosovo.

Children can decide for themselves when they reach adulthood if they want to cover up. Our cultural, national and constitutional values are superior to the interest of individuals or groups to promote foreign cultures and values, which are not in harmony with our social order and with our culture.

Leave the kids alone!

Establishing schooling is a legal obligation, and parents are legally obligated to respect this obligation as well as the rules of schooling in our country. Children will know for themselves how they will manifest their faith after reaching the age of”.
