The head of the Foundation Court in Pristina, Albina Shabani-Rama, said that possible vetoation for judges would harm and overload the institution it heads. It agrees to submit this process as head of the Constitutional Court, but it is against the same passing of Pristina judges.

Shabanan-Rama also spoke of the large number of subjects pending review and the need to build the tribunal's capacities.

The collection of subjects remains a challenge for the Pristina Constitutional Court, and it fears their number could increase even more if judges are subject to vetoation.

I'm not a pro-traumatic because I think it would only do more harm, I'm talking about my court, because self-defence is a process that takes time and I think that it's only going to be wasted and it's going to add more collection. On the other hand, in our court over 90% are judges who don't even have five years of work experience, all have gone through verification processes and various processes. I don't consider it necessary, I consider that the most necessary is the fact that the court is helped, the capacities of this court are established, and then we see the results. As for the rest, for the chairman and member of the Council, it's okay for me, I don't have any comment, if you've predicted and proposed the government and the lawmaker has voted it, it's okay, I think that our share doesn't make much of an obstacle in the trial, but for judges it's a dangerous process if we enter that part because we have to do more harm to citizen”, Shabani-Rama says.

Shaban-Rama says there is already a tendency to increase subjects, mainly of civilian nature.

In the past year alone, she said that over 11,000 new materials have been accepted, and the growth trend points out that she is continuing this year.

We have seen a growing tendency of subjects of all natures since last year, but with particular emphasis on civil nature, and mainly are subjects which come from public workers of educational institutions, medical institutions, but other institutions like the Corresive Service police, which are due to the non-responding of the government's collective contract but also on the part of the municipalities of other institutions. And in this respect the number has increased a lot, so in the past year we have double the number of subjects in counter-civilian procedure, where over 11,000 materials we've accepted, but even this year continue the same trend of growth in subjects, otherwise in criminal and administrative, and in the Randa Crime Department, we have a tendency to increase subjects at”, she said.

Judge Shaban-Rama considers the court's large number of materials collected over the years to be the main challenge.

According to her, the best solution for reducing these expectations is to increase the number of judges in this court.

“The main challenge of this court is the large number of materials collected over the years and which is making even more difficult the large number of incoming subjects in relation to the small number of judges we have. This year, the Pristina Constitutional Court has had a beautiful departure of judges, because part of them have advanced and part of them have been passed to the Commercial Court, which is expected to be realised next month. This has damaged a certain way of Pristina Foundation Court, we have a disbalancing, on one side we have accumulated materials, large numbers of growing materials, while on the other side we also have few judges, but also other administrative staff or supporters. We've recently admitted 20 new judges, for us it's been very good news, we'll expect in six months to start working... This number of judges doesn't even cover their numbers that left this year. Our and mine's request as head of this court is to meet the number of judges that it needs to be done over and over again”, she stressed.

At the Pristina Foundation Court, about 80 thousand materials are pending.

In addition to the large number of subjects, Shaban -Rama ranks as a challenge and addresses identification.

We have approximately 80 thousand electives, so I say it's a number of 30 to 50 (judges) that are needed beyond the previous structure, so we can remove this collection of materials and for a time stabilize the content, because otherwise there will be procrastination of long subjects if we continue with this trend that we have, whether by the removal of judges, whether of the old materials or the collection (s), it says.

The head of the Basic Court in Pristina for Kosova Prees, says that already over 99% of targets are under way.

With my decision as chairman, they've all gone to the Special Department, I can tell you that over 99% of them are at work, are in the process, except one that's recently returned to restoration, is continuing the process because they're more complicated, and that means longer time for treatment to come to a” decision, Sabani-Rama stressed.

Albina Shabanani-Rama says that in recent years the number of cases of domestic violence has increased, but added that there is no delay in treating these subjects.

In order to reduce the number of civilian subjects awaiting treatment at the Pristina Foundation Court, the first of this institution, said they are promoting the mediation procedure. / KP/
