The Appeals Court in Belgrade has said on 16 January that it has overturned the suspended prison sentence for four people suspected and has confirmed the release of three other men from a lower court.
Prosecutors have failed to provide sufficient data to support the indictment, it is said in the statement.
Protesters have attempted to enter the US Embassy in Belgrade and set fire to a section of the building in February 2008, as tens of thousands of people were out in the Serbian capital to protest Kosovo's independence.
A 20-year-old has died in this incident, events that have strained relations between Washington and Belgrade for years.
Tens of other people have been injured in violence involving attacks at other European embassies, but with less damage.
