Kosovo's Assembly has not approved President Hashim Thaci's decision to return the Law to commercial societies, as 28 MPs voted in favour, 32 opposed and 7 abstained. With the president's decision not approved, the bill remains as approved by the amendment, which envisions the quota for businesses to have 40 percent of women on their governing boards.
The MP, who has proposed amendments forcing commercial companies to have 40 per cent women on governing boards, Mimoza Kusari-Lila, said the president's arguments are not sustainable.
“The president's arguments do not stand because he has ignored Article 24 of the constitutional principles and rights of groups that are in uneven positions which apply to changing positions. The constitution requires that institutions guarantee and respect human rights and equal treatment. According to the European Court for Human Rights, it does not prevent a state from treating a different group, but in fact, when there is actual inequality, the state should take measures to improve this”, Kusari-Lila said.
On behalf of the PDK parliamentary group, Memli Krasniqi has voiced opposition to this amendment proposed by Kusari-Lila.
On behalf of the PDK, I announce that we will support the president's recommendation, which is, in fact, the commission's recommendation because, as the constitution predicts, the commission has given support to this recommendation. This amendment does not focus on empowering women in Kosovo businesses, it is a tendency to impose decisions in private business. It does not help free functioning of business in Kosovo and, as such, would have to vote on the commission's recommendation and Mimoza Kusari's amendment to be removed from the bill”, Krasniqi said.
According to him, with this logic of imposing, they are narrowing the functioning and free operation of businesses by imposing on the gender quota, which would have to come naturally.
While MP Fatmire Mulhajura-Kolcak from the Vetevendosje Movement has said they oppose the president's decision and the pro amendment proposed by MP Kusari-Lila.
Impulation and not equality has called it AAK deputy Muharrem Nitaj, setting quotas for private businesses.
