Minister Tahiri against adoption of VV-proposed recommendations in the Assembly

Question: Why do you consider the recommendations adopted yesterday in the Kosovo Assembly to be anti constitutional?
Minister Tahiri: Although the adoption of resolutions and recommendations is the responsibility of the Parliament under the Constitution, certain procedures must also be respected in this case. Understandably, it is the competence and will of MPs, but in terms of content, recommendations are contrary to the constitutional and legal order in Kosovo. According to previous procedures with the Framework Adjust provisions, the Commission for Legislation, Mandate, Immitation, the Framework Rule and the supervision of the Anti-Corruption Agency, among other things, should see these recommendations before they can be put to the polls, aspect of their constitutionality. This procedure was not followed yesterday, the Commission for Legislation, respectively, has not considered these recommendations at all.
Question: In your opinion, why did the Vetevendosje Movement insist on these recommendations?
Minister Tahiri: From the establishment of the Vetevendosje Movement to the present day, this structure, and specifically Albin Kurti, as its leader has characterized the legacy of lawlessness. He also demonstrated this legacy by the way parliamentary debate was initiated in the Republic of Kosovo's Parliamentary Assembly on condemning Vetevendosje activists, taking over the right to contest an entire judicial system, although this system guarantees every citizen the degree of complaint against judicial decisions if it is truly believed there is grounds to contest its decisions.
So, instead of complaining to the second-instance court, they insisted that their complaints be filed in the Kosovo Assembly Hall.
Question: Why do you believe that you chose this approach? Kurt?
This approach, it's not absolutely accidental. It is an expression of Albin Kurt's constant stance against the republican norms and principles of the state of Kosovo. For it seems, more important than the state, every time it was and it's “the” of it ideological. Under the name of the manifesto of this sect as well as its personal cult, Albin has repeatedly attacked state institutions, rule of law and Constitution of the Republic of Kosovo.
The latter, for him, have meant only as much as he could use as instruments for his personal interests. Even the excuse for involvement in state institutional life had done so over these dogmas, claiming that “is just adding more tools to the function of his goals and group representing”. So state institutions for him are just one more tool. So if stones, eggs, damage to public property, violent street protests were added to these instruments, the Assembly of the Republic of Kosovo. The judiciary has repeatedly been the target of this anti-insituent and anti-state game by Albin Kurti. This approach reveals its real goal, to disfunction the judicial system and instances that have constitutional mandate to exercise this task, a highly dangerous strategy for selling law, rule of law and continued efforts of the entire Kosovo society for a genuine democratic order.
Question: After all, how will you handle these recommendations?
Minister Tahiri: The Parliament's resolutions and recommendations, according to free interpretation, have no binding effect/power.
I will remain committed to further empowering rule of law, further modernising the courts and enabling the law to be equal for all citizens, and their decisions to be unconventional by politics.
