A day after it was declared that it would not respond to the invitation of the Special Court, the former soldier of NLACHA, Remzi Shala, known in the war under the nickname “Red Mola”, has left his home. The 54-year-old village of Shiroko, of the Suhareka municipality, is being judged by local justice as the main charge of civil crimes during the war, respectively, the murder of Haxhi Përtesh in 1998. The judicial process in this case is going to the end. On January 9, 2019, means his final defense word
With the last wave of names coming up in the opinion that have received an invitation for an interview by the Special Court is also former soldier Remzi Shala. The 54-year-old, whose name is already working along with the KLA's key figures, who were called for interviews, revealed yesterday exclusively to Gazette Express that he does not recognise this court and will not respond to that call.
But allegations that Shala is involved in committing crimes during the war against the civilian population are not in recent years.
His name, according to the indictment provided by the Express newspaper, figures as the main indictment in the murder of Haxhi Pertesh. For this case, the Constitutional Prosecution in Prizren has filed an indictment in 2016.
On Shala is charged that during the war in Kosovo, respectively, on June 26, 1998, around 11:00, in the village of Duhundl, as part of the Kosovo Liberation Army in uniform and armed with long arms along with 5-6 other armed soldiers and facial masks that have not been identified so far, due to suspicion that Haxhi Perteshi is co-operating with Serb forces, have gone to his house and deprived him of freedom.
According to the indictment, it happened when these suspects went to the victim's house doors and called his name. The call had been answered by the victim's son, Agron Pertesh, who had even invited them in. The defendant, who according to the indictment, was the only one without a mask on his face, has sought to meet with the victim.
“Haji Perteshi was inside the house at that moment after the announcement that Agron appears in the courtyard, where the defendant asks “Are you Haxhia” after response of injured “Yes, I'm” after a short conversation, the defendant only asks him to go with them, that “we want in after a long conversation with you” when the injured man says “Po, where you just want to take over cigarettes”, the defendant says to “so that we have all the lights from the village left at the village, and when they get out of the damaged by their hands, going on foot in the direction of the Caan neighbourhood after a couple of witnesses, you see the lights in the village, Caccacj.
According to what is written, Haxhi Pertesh's body has remained in a closed place for several days, while on July 1, 1998, his lifeless body was found near the road near the center of the village of Duhdhl.
The criminal procedure was initiated when the victim's son had issued a statement on the topic in UNMIK. Later, EULEX required to conduct investigations and interview potential witnesses. In 2014, the EULEX prosecutor made a decision to start investigations in this case.
This case was held to local prosecutors in 2015.
Pertesh's son Agron in August 2014 had declared that he and his family had helped the KLA in various ways. Regarding the night when the witness case occurred, the report points out that the event took place on June 26, 1998, about 9: 00 p.m.
And on the day he found his father's body, he remembered it so.
I wanted to control my father's body, but, my mother, Aja Sejdiu and relatives didn't let me take my clothes off of my father's body saying: That we've checked and that there's no bullet marks and no other signs-plag on the body” but after a few days of corpses had begun to collapse, his body was buried that night around 10 o'clock in the dark in the village cemetery. ”
Asked by the prosecutor whether he was sure that his parent had taken Remzi Shala, the witness who responded to “I'm a mlandad for sure that my father's hand was caught by Remzi Shala, he might not be guilty, but he came home and took it, he should tell about his fate and why he took my father home and my father was found dead”
But Remzi Shala had denied all of this on a TV show, and for this occasion, as Express teaches, the final decision will be made on January 9th of 2019, by the Constitutional Court in Prizren, the Sand Crimes Department.
Shala, known in the war under the nickname “The Red Apple”, has left his home, after he spoke uncletically about Express that he received the invitation and would not respond to the call.
T7 during the day has stayed in his home, and family members have confirmed this.
Shala told Gazeta Express that he would not respond to the call of the Special Court, thus risking being fined or even sentenced to prison, as the call warns.
I, Commander “Red Moll”, of the KLA's Special Staff Unit, have accepted an invitation from the Special Court to surrender to The Hague. I declare before all the people that I will not turn myself in and respond to this invite”, he has said in a proposal for the Express Journal.
The “those who brought me this invitation were declared to be EULEX police officers, while I countered that I did not recognise this court, that I am Albanian, and I am proud of the war I have fought”, he said.
So I appeal to all my friends, both when we pledge our country and the flag, so to be a believer, not to know this court and not to surrender to The Hague”, Shala said.
At the same time, his family have not let him know where he might be right away and whether his flight has anything to do with his special invitation.
