IKD with detailed report on allegations of manipulation in the act of case “Lumez”

The IKD recalls that investigations were conducted by a subordinate of chief state prosecutor, who is chief of the Randa Crime Department at Pristina Foundation Prosecutor Kujtim Munich, KTV reports.
Based on the laws in force, investigations into this case have had to be led by the Special Prosecutor, as the position of chief state prosecutor enters within the highest positions of the state, whose actions are investigated by the SPRK.
So according to the IKD, any action taken by Munich is contrary to the law.
The IKD in the report also mentioned political influences. Justice Minister Abelard Tahiri, during his statement, had prejudged the prosecution's investigations that they would end up in a short time.
In addition to statements made by the Kosovo Prosecutorial Council and the Association of Prosecutors, who have not yet launched investigations, lined up next to Lumez, demanding a break in media research and naming them as a campaign against the State Prosecutor, The IKD has deemed them unjust and prejudiced, which could inevitably reflect on prosecutor Munich's decision.
According to this report, the closure of the case is based on the evidence of former Serbian officials assigned to positions at the time of violent measures in the 1990s, following the surprise of Kosovo's autonomy.
Pocuror Munich has not done management of evidence provided by Albanian witnesses who were members of the Jury Consultative Commission, who Lumez in 2000, when he was competing for judges and prosecutors, had told them he did not have the jurisdictional exam, not even presenting such a certificate.
The IKD, based on the very act of prosecutor Munich, stresses that in Kosovo, the quality of the witness, they have been questioned: Sahit Shala, Radislav Dimitrijevic, Aleksandar Lumezi, Riza Smaka, Adil Fetah, Enver Hasani, Betim Shala and Zymer Krasniqi.
While without having a decision to start investigations and contrary to the Law on International Co-operation, he has received evidence and witnesses off the official legal route.
In this preliminary investigative process, Munich had no suspect but only witnesses.
The Kosovo Institute for Justice in the report has given recommendations on how to handle the case of Alexander Lumez's manipulated file.
They have requested an independent, impartial, just and professional investigative process, which would be conducted by the Special Prosecutor of the Republic of Kosovo through the creation of a team of EULEX prosecutors with American, British and German prosecutors.
The Special Prosecutor is recommended to seek expertise on all documents manipulated by the Iraqis and others allegedly forged. As the Prosecutorial Council takes action regarding the suspension of Chief State Prosecutor Alexander Lumez.
Also, according to the IKD, The PSRK must analyse the decision to drop criminal complaint by Prosecutor Munich and investigate whether the law and procedures under legislation have been implemented during the handling of this case.
