Nevenka Tromp raises concerns about special court legitimacy

The former investigation into the International Criminal Tribunal for the former Yugoslavia, Nevenka Tromp, has spoken about the Specialised Chambers and the judicial process against former KLA leaders in The Hague.

Commenting on England and Wales's Oda Committee of Lawyers for Human Rights, Tromp said the court's isnerisation on this report is not the right way to act.

No serious observer can ever say that the court will have to react during the time it is making a decision because we all know the main evidence has been carried out and we're just waiting for the first degree decision. This court could never be separate from any final decision and the response of Kosovo's Specialised Chambers underscores that, so this is an outside court process that must be followed. But the court's nervousness over this report is not the right way to act, and if perceived as a means to influence judges, I think that nervousness against this report will certainly affect how the decision is accepted by Kosovars. This goes deeply to a second point I want to freeze, it is the court's response to this report, challenges the legitimacy of this court and the view whether this court is objective and impartial”, she said in an exclusive interview on the “show. Info Magazine” in Klan Kosova.

Tromp also took an example from her personal experience in the International Tribunal for the former Yugoslavia, saying Kosovo's Specialised Chambers could face delegation and questioning its credibility.

I give you an example in an institution where I worked, so the International Tribunal for the former Yugoslavia and its president who during her term has said that International Tribunal for Yugoslavia's justice should be understood by people in the former Yugoslavia and the court has important missions to win the hearts and minds of the people of the former Yugoslavia. So the feeling and sense that there is no justice and it is not legitimate in societies that you would have to serve is what Kosovo's Specialised Chambers are facing because the judgment can be accepted in a unfavourable manner and will go directly to the tribunal's delegation and question credibility in the way judicial processes are conducted. That's a big problem, not an issue any court could easily take”, Tromp said.
