Prosecutor Proposes Matican Property Confiscating Over 34m Euros

“Battle for Justice” has secured the Special Prosecutor's Act of the Republic of Kosovo (PSRK) against Bahtir Vitija for criminal activity “Legalisation of false content”, where through an act it had managed to register a real estate in Pristina's Mateican, with a surface of 131,88 square metres.

In this indictment that has now provided “Justice Trust” , The SPRK has proposed that Vitija be confiscated property, with a surface of 131,888 square metres in Matican, the Pristina municipality, worth 34m and 490m and 400 euros.

The indictment reportedly states that from May 20th to December 28, 2022, the year had knowingly presented a false - content document, namely, the 3173 act of 7:05,1970.

The ruling, the year, had submitted it as a cut form of June 16th 1970, claiming it was issued by the Commission for the Review of Property Relations created by social-owned usurpation, aimed at registering real estate.

Property in question was enumerated owned by the Pristina municipality, with the cadastral unit number 156-0, in the cadastral Matican area, with its surface of 131,888 m2, while was later registered on its behalf in the cadastral registry of the Pristina municipality.

The year after he had been refused a second time to register his property through act no. 011-463-2/2042/22 of December 16th, 2022, by the Cadastri Directorate of the Pristina municipality, had filed complaints on December 2022 in the second-degree body of Kosovo's Cadastral Agency.

According to the indictment, he had positioned officials of this institution, who consider it an act of no. 3173 as a real document, on December 28, 2022, they had issued the No. 03/1122/22, through which they had ordered the Cadastre Directorate to make a record of inconsistencies in the matican cadastral area, covering 131,888 square metres, on behalf of the Year.

According to the prosecution, the move has resulted in legalising false contents in public documents, namely in the cadastral registry.

For these actions, Vitija is charged with criminal work “Legalisation of false content” by Article 395, paragraph 1 of the Penal Code of the Republic of Kosovo.

In the indictment it has been stressed that the year is dead, but the prosecutor has estimated that since property rights were illegally acquired, it does not enjoy protection from local and international laws, including the European Union's directives.

According to the prosecution, confiscation of property is in the function of protecting public interest. The criminal procedure is under way under the Law on Expanded Compensities, namely Article 20, which stipulates that the procedure can continue aimed at confiscating material benefits or means used to carry out criminal work.

The trial for this case is under way at the Constitutional Court in Pristina, while the session is expected to be held on March 13th 2026. /Periscope
