Gruda: Osman's decree in full accordance with Constitution, Parliament failed to elect president

Kosovo's “Assembly has consumed its right to elect the president within the constitutional deadline. Consequently, its distribution and presidential decree are fully in line with the Constitution of the Republic of Kosovo”, Gruda said.
“The competition for electing the president is not disreputed, but a positive constitutional obligation. Failure to implement the procedure constitutes an institutional constitutional inaction that blocks the creation of a state body”, Gruda said.
According to him, the interpretation that the Assembly can avoid distribution by not even launching the president's election procedure is contrary to constitutional logic and the principle of the Constitution's effectiveness.
If it is admitted that distribution occurs only after the third vote, then the Assembly may never call the session and extend the mandate beyond constitutional projections. This conflicts with the principle of effectiveness of the Constitution”, he said.
Gruda has said Osmani has acted in accordance with the Constitution.
“The president has acted fully in accordance with the Constitution by exercising its competencies for the distribution of the Parliament and is expected to soon set the date for the elections”, Gruda concluded. /Periscope/
