After Monday's letter to European Union Ambassador (BE) in Kosovo, Aivo Orav, has sent State Chief Prosecutor Agron Qalaj's taskman, voicing serious concern that the new composition of the Kosovo Prosecutorial Council (KPK) has not received the mandate at the constitutional gathering held on January 20th, 2026, Qalaj [...]

In this letter, Qalaj says the certificate is in court procedures that, he says, have been respected. In addition, he stressed that he remains committed to reform in the KKP, reports “Justice Trust“, broadcast Periscope.

In his letter to Ambassador Orav, Qalaj has said that all actions taken so far based on his institutional capacity have been strictly guided by legal and procedural frameworks in power.

“in my institutional capacity, I would like to reiterate that all actions undertaken so far have been strictly guided by the legal and procedural frameworks in power, as well as by the clear and limited competencies defined by the head of state in office during the constitutional phase of the Kosovo Prosecutorial Council”, he said on paper.

In addition, Qalaj said his approach has been oriented towards ensuring procedural legitimacy, institutional stability and protection of the Council's credibility.

U.d. The chief state prosecutor has also said that their institutional decisions were made by the Council as a college organ and that his role has been strictly procedural.

Regarding the handling of additional proposals during the Council's first meeting, including the issue of certificates, a transparent procedure approach has been followed, enabling the presentation and review of the proposal within the college forum, while the authority for eventual decision-making has been fully left to the Council, in accordance with relevant procedure rules”, he said.

Qalaj has said she considers it an institutional obligation to stress that some of the expectations reflected in Orav's letter coincide with attitudes previously unearthed by a segment of Council members.

According to Qalajt, the members in question -- procedural and legal -- are not in line with the constitutional nature of this phase, which at this stage, emphasis and order of institutional action -- he says they are clearly defined by the legal and regulatory frameworks that are applicable and do not allow the consideration of issues that do not directly relate to the institutional institution process.

For this reason, my approach is guided exclusively by the obligation to observe these legal and procedural boundaries”, he said.

He added that the issue of certificate remains the subject of judicial procedures, and on which the issue has a measure of security.

“at the same time, it is important to stress that the issue of the certificate currently remains the subject of ongoing judicial procedures, over which a temporary measure of security has been imposed by the competent court. Moreover, the regulation regulating the procedure for electing the prosecutorial member of the Council is also the object of a special judicial review. In this institutional context, respect for judicial procedures and exercise of proper legal care have necessarily been integral parts of the approach followed. I fully accept and share your emphasis on the necessity of the institutional measures company to ensure the regular functioning of the Council”, he has said.

Qalaj has said his approach has been to protect institutional continuity, judicial security and institutional co-ordination, remaining open to co-ordination and constructive co-operation with international partners. He stressed that he remains committed to the reform process within the KKP.

I became fully committed to the reform process within the Kosovo Prosecutorial Council and advanced the standards of transparency, accountability and institutional governance, in line with the best European practices and common strategic goals. I appreciate the European Union's continued support and remain open to structured institutional dialogue and further co-operation in the interest of strengthening functionality, credibility and stability of the prosecutorial system”, he said in his letter.

Otherwise, Ambassador Orav had sent a letter to Qalajt on January 26th, calling it disappointing that the new KPK composition has failed to receive the mandate at the constitutional gathering held on January 20, 2026.

In that letter, the EU stresses that failure to establish the Council is particularly disappointing, given that the new KPK composition was meant to mark a key step in the current reform process in the prosecutorial system. According to the EU, although reform was aimed at strengthening leadership and complying with the prosecutorial system with principles of rule of law, the Council was prevented from receiving its mandate and starting work as it was previously.

It says that, as a result, the legitimacy of the Council has weakened, while it also undermines the EU's partnership-based commitment with one institution, credibility and dedication to legal, transparent and fair leadership have been questioned.

Furthermore, the letter says the EU has consistently supported KPK reform in order to reduce corruption and strengthen the prosecutorial system's compliance with the principles of rule of law. It is also stressed that reform has been expected to be implemented in trust, with a sincere commitment to institutional development.

Meanwhile, in this context, the EU Office recalled that it expressed earlier and repeatedly serious concerns over decisions that have been procedurally irregular and even illegal, undermining reform implementation. In that sense, the letter said it is unfortunate that a controversial approach to the Council's democratic leadership, under the chairmanship of Qalay, has now prevented him from receiving his mandate.

Otherwise, through a response published on January 21st 2026, the Kosovo Institute for Justice (IKD) has expressed deep concern over the actions of Chief State Prosecutor Agron Qalaj, who, according to them, are directly obstructing reform implementation at the Kosovo Prosecutorial Council (KPK).

According to the IKD, Qalaj is continuing with the old understanding of governance with the Prosecutorial Council, exploiting unfounded legal interpretations of the KKP Secretariat's Legal Office to stall the functioning of the Council and is aiming to preserve a corruptionist mind within the prosecutorial system.
