In the case of Brezovica, we have selective justice in the form of low political revenge. They are often ordinary people who have been forced to build these houses on their land without permission because other municipalities and state institutions have been inefficient in managing increased demand and development needs. Here the key word is private property that is sacred to the liberal-democratic system that we have. As a result of the lack of the will and skills of the rulings so far, but also the irresponsability of the pressures of corruption, detailed urban plans that could be developed in tourist areas have been lacking. Here it also highlights the hypocrisy of the state and its institutions where, on the one hand, it tries to attract foreign investors to tourism, even providing almost free state land for strategic investors, and on the other, it violates its citizens who want to invest savings in their private property.
This means that in most cases moral burden and responsibility should be placed on state institutions, rather than on citizens who want to invest in their property, so organising public operations for sequentine or destruction of illegal construction should be regarded as a serious state failure rather than a criminal sin to citizens.
Another problem is to dominate back then communist mentality, to attack rich people with holiday villas or to destroy private property without worrying about economic damage. A responsible government should not rejoice in the destruction of the property of its citizens, but should focus on legalisations to exhumate and circulate the billions Kosovars have invested in construction, even those without permission. Kosovo does not need an accelerated legalisation process for campaigning or destruction of construction without permission. Once an asset is recognised by a ownership legal registry, this asset, whether business or home, can be used as a mortgaged collateral to obtain loans from a bank by generating extraordinary amounts of capital for investments. It can also be used as a guarantee of business contracts, making sure that property wealth is no longer buried in the bricks of cement but released. Besides, if that property is legally owned then it can be sold to investors everywhere on the global market, becoming liquid capital that is circulated into the economy.
Recently, it should be noted that legalising unlicensed objects is in line with the Vienna Declaration for Free Construction, and that Kosovo is also signatories of this international law document aimed at legalising and regulating areas built without relevant documentation. This means that the legalisation issue is not only a social need and economic benefits, but has already turned into an international commitment to the state of Kosovo.
