A hyjabi again as a public cause. Request this time, besides pre-religious and religious organisations, is supported by even full deputies of Kosovo parliament ( PDK, LVV and minorities. What is the device for these structures?
Today at 9:15, «The newspaper Expres» published the report, titled «Reactualised the question of wearing the headscarf to schools». Initiation of the request this time comes from the «Commission for Human Rights, Gender Equality, for Invisible Persons and Petitionies» within the parliament of the Republic of Kosovo. Its leader is Bosniak ethnicity MP and eventually the moderator of a TV show on TV7 Duda Balje. It for «Radio Europe Free» stated that its commission «is required by the Ministry of Education to change administrative guidelines, or to release a new one, where it will not be forbidden for covered girls to go to school». She then underlined that the issue could be adjusted to laws, but better and faster it would be without them.
Without the laws?
It is the Constitution of Kosovo, Law No. 04/L-032, issued under decree No. DL-035-2011 signed by former President Atifete Jahjaga. The law in preamble is based on Article 65 (1) of the Constitution of the Republic of Kosovo. Also based on these laws is «Direction» of August 06/2014.
Reflecting without excluding the existence of these laws and not wanting to suspend the rule of law, producing <x0juries for better and better», she quoted the media as saying that the «Minister of Education, Science, Technology and Innovation, Arbérie Nagavci, said the ministry is engaged and is working not to be out of the school process. She said that on the school cover issue and not only, debate should be opened and arguments from field experts» should be discussed.
Overly correct stand!
In this direction, Duda Balje, her Commission and organisations that are behind the request for several years. The same BIK, which says again quote from the media: Kosovo's «Islamic Union, meanwhile, has sometimes called for girls wearing headscarves to be allowed schooling at pre-university public educational institutions. They say carrying a covering or headscarf is a duty, respectively, to the female gender».
And here's the central problem of this huge structure, which wants to modify the constitution of a country without a device. With the device here, we mean what Foucaculus said: <x0-structural, which at a historic moment has a function of fulfilling a request; so the device has a strategic function». BIK's device, Duda Balje and numerous PDK deputies, has in focus the intention to cover minor girls with hyjab. Okay. The request is not of the kind to be banned and banned from the civil rights of individuals and associations, either religious or religious. She must have the empathy of the State and is treated seriously. As does Nagavci and her ministry.
Now, on the device Mrs. Nagavci's Ministry is looking for. MANT, the instructions, BIK, the Duda Commission, are; the requirement for allowing hijab is; but what is missing? There is no argument and participation in the discurs of the side that is the device's initial. We don't think about that type participation: «(BIK) They say carrying a covering or headscarf is a must, respectively, for the female genus» or «The Tweed is not religious/political/ideological uniform and it is human right». Not so is the word that comes out of it without a covering or a clear statement.
Strasbourg and a series of international courts have made the verdict: hyjabi is not human right! Because it is political or cultural, so any firm or institution that feels not compatible with the symbols of political Islam can refuse them without violating anyone's rights. Period. So these institutions consider hygiene (not the veil) a uniform motivated by part of a certain religion, ideology, or theopolitical school. As Kosovo Laws and its Constitution currently see.
Isn't that right?
Then the Duda Commission must create an even greater Commission than itself, by lawyers, culturelogist, pre-religious anthropologist (not by religions themselves), who will do adequate expertise, and will probably triumph with the annulment of European and global verdicts on this job. If they win, then even the Kosovo state must accept the hyjab as human rights.
BIK says it's religious duty. Okay. But why do BIK and others not offer the surs (not their interpretations) offer the rules that «owe the» to minor and mature ones to cover their heads? Let's do a basic document from which society will learn, and they'll understand the media that the discours are based on arguments and see what this is about? It is the order of the Koran, the Lord or any particular religious school, is the standard or obligation that comes from the wisdom (as a constitution in itself) and will be convinced that it is not a uniform, but that at the end the state has no path without changing the constitution, the laws, the self, if the religious are right and the hydzab has no record of theopolitical manifestations; it does not discriminate against one gender in favor of the other and the least no minor.
Why don't they?
Or why did the serious parliamentary Commission not offer a high-altitude expertise to become the basis for a sound discour in favour of the device? Duda Balje is free to do this, just like she's free to go out with a hydzab on T7 or walk the streets with a bramble. Why don't you do it? In Bosnia, religion is even one of the main identifying indicators that distinguish Bosnian Muslims from those of the same Christian language. They don't do that because she's grown up and free. How cheap are those that a parent has said: «what do you want me to hold a hyjabin if he loses school»? Why doesn't a parent talk? Because she's a minor?
However, as we see the part of the device that a researcher should contribute is missing. The religious arguments inside the disk are missing. Let them come up with arguments about where order comes from, which is specifically obligation, that lawyers, designers, media, and institutions have the opportunity to understand whether it's law, it's tradition, whether it's law or law, if it's from where? So the state does not violate its laws by overturning them with foreign laws and this conflict would end forever. Or at least until most MPs are no longer in this composition.
No one wants to discriminate against children and at least minor women. Here, then, fill the record with evidence: from where do you come the obligation, and from who did the first material, like where, and why? Offer resources, texts to discuss. Not hyjab people, least minors, do not help such a debate. This debate doesn't help either “«3bar» anfabe or “sexual” foreign political agents, but neutral specialists. Just as one in the report quoted at the outset of this text spoke. You initials and ideologists of coverage such as «of duty and commitment» you need to speak with facts, convince us which Koranic verses require this, which the fatwa launched this work and from where exactly, historically documented comes the idea of female coverage and who it is used of today.
