Chairman of the Supreme Court for Sexist Language in Gjilan: We'll see if he's been rude.

This has been confirmed for Radio Free Europe, the chairman of the Supreme Court of Kosovo, Enver Peci.

Concerns about the use of this language have been raised by civil society, following the report that has made Portal “Justice Trust” on a show entitled “Syxisism in the ruling of the Gjilan Court”, published on December 4th of this year.

The show has discussed the ruling and reasoning of the verdict that has emerged in 2014 by the judge-led court, Aziz Shaqiri and members of this body, judges Naser Maliqi and Ramiz Azazi, at the Constitutional Court in Gjilan, who had issued four prosecutors accused of sexual violence against a woman. The language used in its decision-making and reasoning is supposed to be “biased, sexist and offensive” against the injured.

The chairman of the Supreme Court of Kosovo, Enver Peci, says that as competent authority, he has requested additional information from “The Justice Vow” to see if there has been improper evental behaviour reflected in the Constitutional Court's act in Gjilan.

“As competent authority, I will look at all documentation and show, as well as take action as the law envisions, if there are elements of the improper conduct of the officers of judicial functions in this case”, says Peci.

The case and what is said in the court's decision

As the “Justice Vow” reported, in November 2012 a woman had reported to the Kosovo Police that she had been the victim of rape by five people in different countries during May of that same year.

The Declaration of Hurtfulness, the prosecution, has turned the charge against five persons for sexual rape.

On February 25, 2013, the Constitutional Court in Gjilan had declared a punishment act, and the defendants had sentenced them to effective prison. One accused in this case had been sentenced to effective prison terms for two years. Three others were sentenced to one year in effective prison and another to nine months in effective prison.

Against the trial, the Gjilan Prosecutor and the defense of the accused had complained at the Court of Appeals. The latter had reversed the sentence, restoring the subject to retrial.

The retrial has been led by Judge Aziz Shaqiri, as chairman of the court, as well as Naser Maliqi and Ramiz Azazi, as jurors. For one accused, the procedure was isolated. Meanwhile, the damaged one had failed to be found by the court and had not testified in the retrial. Her statement given to the police was administered as evidence by the court.
