A blow to Kosovo

Political activists began and were imprisoned. The students continued, and they appeared in front of the tanks. The people tied their arms and protested. They were shot. They were oppressed by violence. But the crowds only grew. Disappointing erupted. Kosovo's Liberation Army was born as the new hope, which at The Hague is now being called the Joint Crime Company.

This could be a quick confession of our fate and misfortune as a people to freedom and independence...

Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi with fellow fighters in The Hague and in Kosovo were brought to the fore against multi-year-old injustices. Now, however, they themselves are facing a new injustice. St. Augustine's century-old dilemma of what sovereignty is, in the absence of justice, in addition to organised robbery, took on November 5, 2020. The four were organisedly taken away and sent to The Hague's Pre-trial Centre.

Those who promote the “Court of Conscience” originally had a very simple way of understanding justice: People must be given what they deserve. However, the real difficulty began with understanding who deserved what, and why?

Even in Kosovo it is almost understandable to all that the Special Court was a specialised fraud that we did not deserve. It was understandable I also believe in those who are temporarily in The Hague, but in the face of state interest, they were not concerned about personal fate. But now, when even the very reason for this court's existence is compromised, distorted and abused, we have yet to understand why it is.

They launched it as an investigation to whitewash Dick Marty's claims and ended up without any claim to his indictment against KLA leaders.

Kosovo could not agree to investigate those claims, and the international community could not support investigations about them. But the Special Court itself is now confirming that Dick Marty's report was a fraud, not including any claim. Also, the trial itself, managed by this court, from the publication of the announcement of the surrender of the indictment until its failure to surrender even after a year, is being testified every time, which is the continuation of a specialised fraud.

Hashim Thaci was very quick to send him to The Hague and not let even the president's mandate finish. But today, a year after, no investigations have yet closed, nor has the full indictment yet been handed over. This is absurd in itself and has nothing to do with local and international justice.

They removed a elected president from the political scene, without even shutting down the investigation, not even ready for trial, and spent a year keeping the four in custody. So unconvincing are the reasonings that they are dealing with the risk of fleeing a former prime minister and president, who has also given up immunity and position as president to face this “justice”. They are seeing opportunities to prevent justice from them when neither in their highest state capacities as prime minister and president or as former prime ministers, such as the most powerful people in Kosovo, never prevented but always cooperated, knowing themselves were the main targets.

Furthermore, Hashim Thaci as the main target of Dick Marty was also the man who agreed to establish this court, because in any alternative, Kosovo would definitely have to face its infamous report. However, not even after ten years of investigation, no word on organ trafficking has been included in either of those general acts that the Special Court has issued.

Their detention is continuing to be argued with weak arguments, with general and hyperbolised concerns about the risk of fleeing and possible intimidation of witnesses when, according to defence, no witness names are yet known.

This was the basis for which Kosovo and the international community were hired to be investigated and tried, because these were also Dick Marty's claims. While, instead of involvement in his claims, the Special Court ended up in some weak and groundless charges of incriminating General Staff. The KLA has no connection with Dick Marty's report.

This confirms once again that Dick Marty deceived the Council of Europe and Kosovo suffered unjustly the extremely harmful consequences of his report.

Otherwise, it is unthinkable that on such terrain, so weak, a court would support indefinite detention in any of the states that finance the Special Court. But, ironically, this is happening in the house of justice between Hage only for former KLA leaders and former Kosovo state leaders. It is unthinkable that the criticism of a president for injustice to Kosovo, in any states that finance this court, will be interpreted as a obstruction of justice. But they were thus interpreted in the case of the former prime minister and former Kosovo president to justify holding him in custody.

While the Pre-Procedure Procedure Judge has allowed the prosecutor to edit a large portion of the indictment, it became a year in custody and they are still not informed exactly which concrete charges weigh upon them. Every corner in the world, the purpose of the indictment is to inform the accused of the charges against him. But, even after a year in custody, the Special Court is still hiding concrete charges against them. Every corner in the world the justice system is divided into several pillars and a certain Professional Conduct Code is respected, but at the Special Court prosecutors and judges are also co-ordinated without protection. Every corner in the world, the ombudsman defends the interests of the accused, while in the special court case he also defends the interests of the prosecution and the court.

The international community forced Kosovo to establish the Special Court to address the false charges of Dick Marty's report. But when they were unable to find evidence to support those claims, the Specialised Prosecutor's Office appeared with new claims to justify their fraud. Such fraud would not have been tolerated in any European Union state, but is always being tolerated when victims of fraud are Albanians.

Albanians are the only ones in the region who have never avoided international justice. We are the only ones in the entire Western Balkans who have been left isolated, deceived, and tried without even observing the rights of the accused and without hurting even the European conscience.

Hashim Thaci, Kadri Veselini, Jakup Krasniqi, Rexhep Selimi and their fellow fighters being held at The Hague are missing Kosovo. But, after the first public appearance of the KLA in November, two decades after the war ended, this new battle in the future will be remembered as the last November glorious battle for protecting the KLA's fair and clean war.

They neither defeat nor break, and former American General Wesley Clark described them well in the past few days.

This Special Court is a challenge that will be spent in a few years. A person may even enjoy it and enjoy it, but he should know that he can spend the rest of his life in shame.
