It says: Baton Haxhiu
Last week revealed much from Albin Kurt's relationship with institutional life and the constitutional order of Kosovo in general.
The Constitutional Court confirmed that the Kurti Government made a second violation during the implementation of measures to curb pandemic.
The first offense was quite evident from the beginning: however, despite the much more serious in content, it can be viewed as easier politically. After all, it is natural to err in interpretation of the Constitution or to become an unintentional concession.
Kurt, of course, would never have forgiven his opponents for this mistake. “ “The breaker of the Constitution” said Kurti once was “supperriminel”. With this stance he not only showed his true culture, which today covers in Kosovo's poison-filled language and hatred of his friends but also full ignorance of Kosovo's civil, criminal and constitutional order.
Despite that, taking into account the pandemic in Kosovo, the general public and almost all political parties displayed abundant consensus regarding the violation of the Constitution by Kurti.
Albin Kurti described it as a minor violation that is not a basis for resigning, despite being dismissed by the absolute majority of the Parliament. It seems Kurt has forgotten the time when Behgjet Pacolli had resigned from the post of president just because he had raised his hand completely purposely at the Assembly session.
So for a minor violation in Kosovo followed a major political crisis just because what was not disputed was respect for the Constitution by all.
Today, meanwhile, with the greatest promoter of rule of law -- the dismissed Prime Minister Kurti -- we are in a situation where we have marked the major setback in the seriousness of access to constitutional order violations.
Instead of taking responsibility as a statesman, he makes word games and hides behind the pandemic to justify breaking constitutional rules in Kosovo. A few days ago, the Constitutional Court found the second violation of Minister Vitita.
The point of judgment is Prizren's quarantine is of no consequence this time. If the first offense was a coincidence, the second offense shows complete disregard, deep and serious contempt of Kosovo's constitutional order.
So even if the second constitutional offense has been easier, it is politically very serious. This shows that we are dealing with a government that openly ignores the Constitution and gives priority to the executive over constitutionality.
Kurt says that these violations are due to the need to take action against pandemic, it is almost foolish not to know that the Constitution cannot be violated in the name of pandemic. However, the situation would be different if a threatening letter by Albin Kurti was not published in the media.
His language is not the innovation: he is already known for his frenzied language when he is an opposition, but with glad tidings of Republika Srpska and Alexander Vuciqi's humanitarian actions in northern Kosovo. The whole point is that Kurti explains the law to the Constitutional judges and tells them what he expects of it in the future.
So, the prime minister dismissed from the Parliament (in other words, without democratic legitimacy), overstepping both procedural and politically over the Constitutional Court. This is the main evidence of his authoritarian tendencies and problematic relationship with power sharing.
He thinks he can deal with all Kosovo's free citizens and with all powers as he rules his party activists. The man with his mouth full of words about the rule of law and the independence of the judiciary is one who not only breaks the Constitution repeatedly, not only constantly relating these violations but also intends to order the judges of the Constitutional Court what decisions they must make.
By the way, one more question. Why should he not, along with Kurt, immediately resign even Arben Vitita after violating the Constitution? Because it's a pandemic time? What time were Agim Veliu and Avdullah Hoti fired? It was amid waves of pandemic when their work was necessary to curb it.
So Albin Kurti and Vetevendosje are making fun of all of Kosovo because of their double standards. If no constitutional offense was enough, Arben Vitita has already had to go home because today she bears institutional and moral responsibility for yesterday's death of the 26-year-old youth in quarantine in the middle of Pristina.
A youth with recorded health problems who was prevented from contacting his family and receiving adequate health care only because he did not shoot an estrada star or a Vetevendosje activist.
Now, yes. Under these circumstances, Albin Kurti and Arben Vitita both deserve to be called Supercriminals.
