The Democratic Party of Kosovo welcomes the decision issued by the Constitutional Court today, which granted the indictment that the PDK has filed against Albin Kurti's banned government, particularly Health Minister Arben Vitita, on 17 April.
At a press conference, MP Besa Ismaili has said the violation of the Constitution by this government is taking place for the second time and measures must be taken.
This is the complete statement of the deputy Ishmael:
In the issue that we as PDK submitted, we argued that the outgoing minister's decisions, Arben Vitita, constituted a violation of the Constitutional Court of Kosovo, and that was confirmed today by the Constitutional Court.
We've disputed with the Court four decisions of the Ministry of Health, which are the same and uniform with dozens of his other decisions and in each case proved they have been contrary to the Constitution. As a result, all other decisions also represent violations of the Constitution.
Today's Constitutional Court Act confirms for the second time that the government at Kurt's departure has tried to focus all powers on its own hands, severely violating basic human freedoms.
The Vetevendosje movement has come to power by misleading citizens as the party that will guarantee rule of law in Kosovo, and in a few weeks power discredited itself by violating at least twice the highest judicial act of our state, the Constitution.
Likewise, trying to make decisions that do not belong to him, bypassing and overstepping the legislative power of the Parliament, demonstrates an outstanding lack of respect for the party's democracy and democratic institutions and procedures.
We are convinced that taking illegal decisions by the dismissed Minister of Vitita in excess of legal competencies also constitutes a criminal offence. Therefore, we call on the state prosecutor to take legal steps against this wrongdoer.
Today's Constitutional Court verdict again demonstrates the serious vulnerability the dismissed Kurti government has made to democracy and the constitutional order of Kosovo. This way it proves once again that the Kurti government has deserved to be dismissed with over 2/3rd of the Kosovo Parliament vote./
