PDK: Kurti government usurped power and violated constitutional order by limiting freedom of movement

The Democratic Party of Kosovo strongly condemns the outgoing Government's attempt to violate democratic and constitutional order through its decisions. The newly made decision by the Government on Kosovo's departure is an illegal act because it flagrantly violates the Constitution of the Republic of Kosovo. Freedom of movement and other freedoms affected by recent measures taken by the government are sacred and guaranteed by the Constitution of the Republic of Kosovo and international conventions on the rights and freedoms of the people that Kosovo has approved.
Article 56 of the Constitution of Kosovo on Founding Rights and Freedoms is clearly and unequivocally expressed, “that avoiding fundamental rights and freedoms that are protected by the Constitution can only be done after declaring the extraordinary situation”.
So, obviously, this government has exceeded its competencies, while it has not yet been approved in the Kosovo Parliament of Foreign State proclamation.
The Democratic Party of Kosovo has already indicated that the Government of Kosovo has shown a delay, failing and neglect in regard to measures taken to counter the pandemic and has proposed the announcement of the extraordinary situation as the right step to deal properly with the threat of pandemic. But it will by no means allow outgoing prime minister Kurti to exploit the situation to violate the rule of law, to give himself powers they do not meet by violating the Constitution.
Therefore, we call on the Government of Kosovo to withdraw this anti-unconstitutional decision and support the provision of the extraordinary situation as soon as possible that will enable anti-independence measures to be undertaken in a legal way.
