Constitutional Court with additional announcement of president's request
After Kosovo President Hashim Thaci has submitted to the Constitutional Court, the requirement for constitutional intervention, to the Government of Kosovo's decision on limiting the free movement of citizens, the Constitutional Court through an announcement has detailed.
This is the full announcement:
The Constitutional Court of the Republic of Kosovo has accepted on Tuesday, March 24, 2020, a request submitted by the president of the Republic of Kosovo, his excellence, Mr. Hashim Thaci, for the subject of the review, has “assessment of the issue of compliance with the Government of the Republic of Kosovo's decision no. 0115, dated 23.03.2020, with the Constitution of the Republic of Kosovo, in terms of restricting fundamental rights and freedoms that protect themselves with the Constitution”.
In addition, in the put forward request, the president of the Republic of Kosovo has demanded from the Court that “impose temporary measures on the issue raised, until the final decision”, through which the implementation of the supreme decision of the Government of the Republic of Kosovo would be suspended.
With the aim of urgent and comprehensive examination of the request, the Court has demanded from all parties of interest in this case:
a.) Comments pertaining to the request for the provisional measure's appointment to submit to the Constitutional Court's official email today, on March 24, 2020, until 10: 00 p.m;
b.) Comments as far as the demand is concerned, submit to the Court in the three-day term (3) from the moment the application was admitted.
The announcement of registration of the request submitted by the president of the Republic of Kosovo and of the handover of comments has already been sent: Kosovo Prime Minister's Office; Kosovo Parliament Speaker, with the specific request that the copy of the request be sent to all MPs in the Parliament; and to the ombudsman.
Given the existing situation in which our country is located, the Constitutional Court is committed to complying with its responsibilities and constitutional function, this subject to address with urgency and high priority.
