The Special Court could file charges for high profiles and politicians even before the 6 October elections.
So has the accredited lawyer of this Court at The Hague, Tome Gashi.
He has clarified the situation and the work of the Special Court in relation to the establishment of charges, and has also said there is no amnesty against any official in Kosovo.
The Special Court is not at all related to political developments in Kosovo, and there is no obstacle that if they claim they have evidence of someone who finds his name in Dick Marty's report not to investigate them and if they go any further if they have enough evidence to raise the charges at any time regardless of whether Kosovo is on the electoral threshold or not, no matter what the prime minister's name is, head of state or chief-parliamentman or someone else”, Gashi told the news.
Lawyer Gashi has indicated that local policy in Kosovo has no influence over the Special Court, and according to him has confirmed the invitation to Prime Minister Haradinaj.
The “has since become known that they are not very politically influenced by Kosovo politics, there are certainly international influences, but not by local politics, regardless of any function they have, whether political or state, had no impact on at least preventing their investigation, and this has been proved by sending out an invitation to Mr. Haradinaj, who when he accepted the invitation has been the country's prime minister”, Gashi told the news.net.
According to lawyer Tome Gashi, the establishment of eventual charges cannot be prevented by any politician either because of positions or because of the political situation.
Gashi has explained that raising the charges whenever it happens would cause political turbulence, but not destabilisation.
I don't think any of them can prevent the rising of the eventual charges because of the positions they have or because of the political situation we are now. Of course, if such a thing happens now, herdo-Kurdish will cause political turbulence but in no way will create destabilisation and certainly if there is an eventuality of the establishment of any act or invitation to any leader of any party this would certainly affect the election we have on October 6th, but I hope that no Albanian will happen, and I don't think that any Albanians enjoy the rise of charges against former KLA fighters specifically against those mentioned in Dick Marty's report because not only would they personally hurt but also the Albanians in general of Kosovo and the former KLA, the former Gashi>
Gashi has said the establishment of the evental charges could occur at any time for anyone who was mentioned in Dick Marty's report, but also for others.
He has called “the gift”, the formation of the Special Law by Kosovo Assembly deputies, saying it goes to the borders of a racial law that has housed Serbs from war crimes in Kosovo.
“The rise of such charges could have occurred at any time and against anyone whose name was mentioned in Dick Marty's report, but other people who do not find themselves in this report may have been hit by the Special Court, but that is, we say, a gift, say, a gift from Kosovo deputies in 2015, where they have issued a law Sui Generisić a law against Albanian self-member and anti-nationalist that can reach the limits of a racial law because it will only accuse Albanians and not Serbs who committed thousands and thousands of killings of Albanian civilians that this number amounts to 15,000 , destructive and all known, but with the release of this law they have actually issued a kind of amnesty for all Serbs who have been involved in cases of war crimes against Albanian victims because no Serb will be indicted at the Special Court<1x>, the news has reported Gashi.
In the end, Gashi has reiterated that no one has immunity from the Special Court, and according to him the establishment of charges could occur at any time.
For your question, I tell anyone who has any function and any name that has state, political function, party has no immunity from prosecution at the Special Court and we hope it doesn't happen but can be theoretically charged at any time, namely, when the Special Court prosecutor thinks there is sufficient evidence to happen this”, Gashi said at the end.
It is noteworthy that even high profiles of the Kosovo Liberation Army, such as Sylejman Selimi, Rrustem Mustafa and Sami Lushtaku, have been invited from this tribunal.
Recently, this court has also been invited to interview former Kosovo Prime Minister Ramush Haradinaj, who has been interviewed in the quality of the suspect.
