KMDLNj: Justice minister has no mandate to release convicted persons

The Council for Protection of Human Rights and Freedoms, through a reaction, has clarified that the justice minister has no mandate to release convicted persons, as it was, from US Ambassador to Kosovo Philip Costnet. Full response of KMDLNJ:

Days ago, the US ambassador to Kosovo, Mr. Kosnet reacted by opposing, as he says the release of a war crimes convict for “ratin of Kukes” from the Ministry of Justice, Mr. Abelard Tahiri. There was then a clarification of Minister Abelard Tahiri, who did not conclude the case because opinion in most of such cases has no information about how convicts were released and whose responsibility is to release convicts. The KMDLNI has had information on which convicted is the word that then became public his name is about Sabit Gecin, respectively.

Now, for opinion it should be clarified that under no circumstances the minister of justice, in concrete case Abelard Tahiri has no right to sign the release of a convict. The release of the convicts only made the Treaty for Freedom with Kusht, in case it estimates that conditions have been met as if the president of Kosovo has that right, at the recommendation of the Commission.

In the case of Sabit Geci, as far as KMDLNI is concerned, we are dealing with the suspension of the sentence for heavy emergency situations and the provision of the opportunity for recovery outside the correctional institutions and, in some cases, outside Kosovo's territory. From the face of human rights in view of Sabit Geci's extremely serious health condition, the decision to suspend the sentence is fair. The KMDLNj was engaged that, in extremely heavy health cases, the sentence should be suspended, as was the D.H. case.

The KMDLNj has rejected and rejected the discriminatory treatment of convicted persons because in detention and prison institutions there are approximately similar or even more serious cases than S.G., who have not been suspended detention and have subsequently died in prisons or are likely to die in prisons.

KMDLNj has rejected and opposed convicts who have no major health problems to take advantage of those who are seriously ill. This is the VIP category of prisoners who have been in Kosovo prisons since the end of the war until today.

For this reason it is necessary to build a hospital only to be imprisoned within the Kosovo Correcting Service, while the so-called safe chamber “ “does not make a solution, but only does it warrant the discrimination of convicts and legalise corruption. Since the end of the Kosovo war, only two categories have suffered within the SKK:

One health personnel forced by powerful people (with political orders or corruption) to give false evidence of the state of health and convicts, and

Two correctional officers who have suffered during the transport of those deprived of freedom to hospitals or KKUK, or while guarding in these institutions of persons deprived of freedom. A large number of them have ended up with charges filed or are in court processes.

Ambassador Costnet's reaction, KMDLNj does not take it as a threat to the judiciary or the Ministry of Justice, in the concrete case of minister Tahiri, but as signalling to the discrimination treatment of persons deprived of freedom, those with strong political support and strong material and social status, respectively, as uncondemned. The truth should be said that even today powerful people who are deprived of freedom rarely have the guts to tell you <x0... will smoke the tobacco”. This phenomenon must be fought and not done sufficiently until now.

Only should a clarification be made of what parole means, the release of the president, the fair outcome of the sentence, and the provisional suspension of the sentence for health or other causes.
