However, what sentence the Criminal Procedure Code provides for two acts the police are accused of. So justice organs can condemn the same one over 10 years in prison.
According to Article 341, KPK, which speaks of blackmail, it is clear that anyone who, with the intention of illegally benefiting rich for himself or the other person, casts out the other person that he will discover something about him or his relatives who will damage their honor or authority and thus force such a person to commit or to do any harm to his or the other person's property, be fined and sentenced to six months' imprisonment (6) to five years.
Article 239 shows that sexual abuse by misusing position, authority, or profession unless it is presented otherwise in this chapter, anyone who forces the other person to commit sexual acts in one or more of the following circumstances is sentenced to imprisonment of 1 to five years.
It is noteworthy that the Kosovo Police Inspectorate through operational routes has accepted anonymous information regarding allegations of committing illegal actions by a police official at the Drinas Police Station (with the rank of sergeant).
Upon accepting the information, IPK investigators have begun to take investigative action in co-ordination with the State Prosecutor.
As a result of these investigative actions, IPK investigators have carried out yesterday (05.02.2019) a warrant for raids on several locations including the suspect's home, his office at the Police Station in Drenas and a private (medical) orientation.
Several items that can serve as evidence in criminal procedure have been seized during the raid.
After interviewing the suspect (Police officers with initial V. The same V) has been arrested by the Police Inspectorate and the prosecutor's decision has been assigned the 48-hour ban on suspicion that the same has committed the criminal work of “rape” and “sexual mismanagement by misusing position, authority or profession (predestined at Article 239 of the Penal Code).
