Former Suhareka Chairman Freed of Corruption Charge

The indictment against them was announced Thursday by the chairman of the court, Judge Artan Seyran, who has said it has not been proven that the three indictees have committed the criminal work they are charged with.
He has said that the expenses of this criminal procedure fall on the burden of this court.
According to the Basic Prosecutor's Act in Prizren, founded on October 22nd 2018, defendant Sali Asllanaj is suspected that from September 1st 2014 to November 27, 2014, in the quality of the official person -- the mayor of the Suhareka municipality -- that by exploiting his official position, he exceeds his competencies with the aim of benefiting any benefit to the other person, while at the same time causing damage to the Republic of Kosovo budget.
According to the indictment, Aslan, as the head of the Suhareka municipality, without tender procedure, signed the agreement for understanding and co-finance between the Suhareka municipality and NGO “Kosovo Hope” for the student sub-transport “project, violating the Public Procurement Law, Public Finance Management Law, and Financial Rule, with what causes damage to Kosovo's budget in a total of 10.5 euros.
With this, he is accused of committing criminal work “the misuse of official position or authority”, by Article 422 of the Republic of Kosovo Penal Code.
And Sheriff Berisha, charged with that from September 16th 2014 to November 27, 2014, in terms of the official person-director of the Education Directorate in Suhareka, misusing his official duties, allows primary school director “Bairam Curri” in the village of Sueleka, Milazim Hajdari, to issue reports of carrying students to the period from 16 September to 27 November, economic operator “Saba Tours”, supposedly the operator has performed the student transport service.
In the indictment, it is said the same in the same period of time has issued three reports to operator “Call Tours”, causing damage to Kosovo's budget at the value of 6572 euros, because this amount was paid to the operator “Saba Group” for the service he had not performed.
Also, according to the indictment, Berisha has caused damage to the state budget of about 4,000 euros, because as responsible for project management, he had not asked for tools that had not been spent by the share of the overall investment agreement for understanding and co-finance between the Suhareka municipality and the NGO “Kosovo Hope”.
With this, it is accused of committing criminal work “the misuse of official position or authority”, by Article 422 of the Republic of Kosovo Penal Code.
While, as Justice Vow writes, the accused, Milazim Hajdari, in quality of primary school director “Bajram Curri” in the village of Nisor of the Suhareka municipality, is accused of exceeding his competencies in order to benefit the other person by causing damage to the state budget, and by compiled reports of carrying various students through which he violates the law on his duties.
According to the prosecution organ, the damage it does to the Republic of Kosovo budget amounts to 6572 euros.
With this, it is accused of committing criminal work “the misuse of official position or authority”, by Article 422 of the Republic of Kosovo Penal Code.
