The Constitutional Prosecutor in Prizren, the Department of the Ra's Crimes, has filed an indictment against I.T., J.V., E.T., A.T., I.B., and the United States, in the quality of official persons, due to the suspicion that, on the basis of co-ordination, they have carried out the criminal work “due to the use of official position or authority” by Article 414 paragraph 2-1 concerning the 31st Criminal Code of the Republic of Kosovo <0>
According to the indictment, dated 19.07.2019 and 21.07.2019 in Prizren at the”Abi Charshia”, accused I.T., in the quality of the inspectors' director, J.V., and E.T.T., construction inspectors, A.T., and I.B., officials at the Inspectors' Directorate as well as the S.K., legal representative in Prizren's municipality, in the quality of official persons, exploiting or overcoming their authority with the intent of harming <2x> ShPK ksi Prizren, in a way that achieves the collapse of anaxis object “Abi Charshia” knowing that the injured has handed in the application for legalisation.
The accused act in opposition to the Law to dealing with illegal construction, contrary to administrative guidelines No.06/19 of the 1207.2019, the Law on General Administration Procedures, as well as contrary to decisions by the Ministry of Environment and Spatial Planning, with which the decisions of the League of Communist Ins of Buildings in Prizren have been annulled, tasking Prizren's Communist bodies to act on the constitutional law to treat construction without permission and administrative guidelines in force. Therefore, those accused of disregarding the decisions of the Ministry of Environment and Spatial Planning act contrary to the laws in power to cerces during the collapse, “Abi” The SKP in Prizren is hurt in the amount of 69,729.66 euros.
With these actions, there is good-based doubt that accused I.T., J.V., E.T., A.T., I.B., and the United States have fulfilled elements of criminal work “due to the use of official position or authority under KPRK.
The prosecutor of the case in the case of the indictment's establishment has proposed to the court that the accused be found guilty and be punished according to the law for the criminal offence.
