Nearly five years after the establishment of indictment and three - degree judgments, the Supreme Court has turned into retrial from the first case “Drenica 1”.
The court has approved the request for protection of legitimacy, proving defence claims for violating legal procedures in the appointment of Anna Adamscas, in the composition of the trial's shame by the head of this body, Darius Sillicki, reports KTV.
According to Tome Gashi, the lawyer of the convicted in this case, Sylejman Selimi, this Supreme decision has been made on the last day of EULEX's mandate.
The positive impact on the 35-page argument, according to Gashi, has also had statements by former EULEX Judges Assembly Chief Chairman Malcolm Simmons.
He insists that all punishment decisions in this case have been taken with non-releciable evidence.
However, he adds that even the latest decision on retrial is flawed until his client is not relieved of the penalty measure.
This delayed decision, he says, testifies to the innocence of former KLA Chief of General Staff Sylejman Selimi, and others.
In 2015, Kohavision had reported on procedural irregularities in the appointment of Anna Adamscas part of the court in this case.
The chairman of the court, Darius Sillicki, had passed two judges in line to be assigned to this panel, assigning parts of the body to Adamscan that he was with at the time.
In July 2017, the Supreme Court had acquitted Sami Lushtaku of being sentenced to eight years in prison to Sylejman Selimi and confirmed the previous five-year prison sentence, Jahir Demak.
