ATK: MP Milaim Zeka owes state 80 thousand euros

The investigation report claims that the deviation was carried out between 2012- 2017 by Zeka's two businesses, the Media Centre “Kosovo Mosaic” and “Ilar Krasniqi & Milaim Zeka” OP. Details of the alleged tax evasion of Zeka's former workshop, Ilir Krasniqi, have been provided in the Taxing Report.

The Department of Tax and Intelligence Investigations based on the investigative record, claims that Milaim Zeka in the quality of business owner Centre Mediale “Kosovo's mosaic”, for the 2012-2017 periods, has avoided duty on personal income, pension contributions to the owner, tax kept at the source for workers' salaries and pension contributions to workers. The total value ATK claims Zeka has left the tax of 81 thousand and 192 euros and 72 cents.

It is said that Zeka declared just 11,400 euros in 2012, while from 2013 to 2017, she declared nothing. Meanwhile, on the table reflected in the ATK report, Zeka's businesses reportedly had a circulation of 536 thousand and 197 euros between 2012 and 2017.

With this circulation, ATK claims annual tax evasion has been made for each of the past six years. In all, the alleged avoidance of Zeka's businesses from Tax in the annual Tax Future for six years (2012-2017) was 49 thousand and 570 euros. Avoiding the owner's pension contributions, according to ATK, was 12 thousand and 585 euros. The report even finds that taxes are not paid to workers.

The report says that avoiding “pension contributions for workers for 2012, 2013, 2014, 2015, 2016 and 2017 was worth 11,258 euros”. However, tax evasion in the Source for workers was worth 6 thousand and 778 euros.

These debts, from ATK investigators, are calculated for Zeka's two businesses.

“In the case of the pre-checking conducted in the ATK SIGTAS system, we have a different system where the system has combined revenues from partnership and from the individual business of defendant Milaim Zeka with a fiscal number, which says the law and therefore the administrative tax procedures does not match the tax penalty procedure. Tax evasion works have happened just as we mentioned them in the final investigative report and remain the same”, said the ATK report.

The newspaper Life in Kosovo has found that the report has already been delivered to the state prosecutor. The report is required by the state prosecution to launch investigation into tax evasion.

The “based on the final investigation file... has proved a suspicion based on suspects according to point 4, V. FINAL ERITMENT, has committed the criminal offence of tax evasion according to Article 313 of the Republic of Kosovo Penal Code and Article 63 of the Law for ATK and Procedures, damaging the budget of the Republic of Kosovo”, the ATK report said.

Milaim Zeka himself in a callous conversation.com has disputed the ATK findings that he is out of tax with his business.

I'm saying, in the first place, that I'm not even running away from the state, and that's the prosecutor's absolute factory of even ATK investigators. It's scandalous, it's very biased and it's a criminal offense by the special prosecutor and the ATK investigators that such a final report fell into the hands of the media before it fell into my hand”, Zeka said.

Zeka claims there are some documentations proving the opposite of ATK's findings by presenting the declaration provided by ATK, which says “the person is registered in the ATK and has no actual untainted tax debts or other tax obligations”.

On the date 3107.2017, I requested confirmation from ATK that I have no obligation to the state. I have declared in 2012, 2013, 2014, 2015, 2016, and 2017 total 492,269.81 I have earned 98,453,96 euros and paid the state 9,845.40 euros”, Zeka said.

But, in Article 20 of the Law on Tax Administration and Procedures, ATK can reportedly investigate businesses allegedly out of taxes six years later.

“Subscribing to paragraph 2. of this article, all taxes should be assessed within six years of the date when the tax declaration to which the assessment is linked has been binding, or the date the declaration was presented, whatever the latter is”, it says in the law.

While Article 2 of this law says the general director can make an assessment at any time in the event: a person has not submitted tax statements; a person, with the aim of avoiding taxes, has submitted a tax form; or the fraudulent behavior of a third person has led to the underreport of tax or overload of credit.

Despite the report's calling it fabricated, MP Zeka says he is willing to pay the tax if he proves it. Zeka even claims to have visited her ATK immediately after the request for an interview by KALLXO.com

I was in ATK the moment you called me on the phone and I told them that if there really is any debt I owe to ATK, let's run the programming. I get three-year programming and I pay. I'm willing to pay, whenever he tells me ATK”, he said.

Zeka says it's only portal, not the oil refinery, and for the years 2012-2017 has paid the state tax for about 10,000 euros. The tax paid, according to Zeka, is only for his portal, but not for the business he had with Ilir Krasniqi, since this business had only been operational for a month.

I'm a portal, not an oil refinery. I paid the state 9 grand 845 euros... Business with Ilir Krasniqi is registered in June, in July, I asked for the removal of business”, he said.

Zeka says he has a deliberate and purposeless tax escape and that any decision he makes ATK, he will respond to the state.

“Report to the state, even to Sweden, if you declare it to the state, does not deliberately condition tax evasion. I've stated, ATK can tell you've been declassified, but you've mispronounced, and I answer that I'm not saying I'm not paying taxes”, Zeka said.

Zeka said he has twice issued statements before prosecutors, but says he is the victim of visa liberalisation.
