In KTV's interactive, Blakaj has indicated that suspects Jovica Dejanovic and Djordje Boykovic had been released with the reasoning that their identification procedure by the victim was not by standards.
Investigations into the case had begun in 2012. Blakaj has said he is still aware why UNMIK had investigated the case even though the victim had presented him long ago. Blakaj has indicated that in April 2013 he had launched and completed the entire process at the Mitrovica Foundation Court.
The founder had declared Dejanovic and Boykovic innocent, while Blakaj says it had come because of a Hests release.
They turned out innocent. We were surprised. We think the evidence has matched each other and all witnesses identified the first indictee Dejanovic and the second only victim. It was decided that there was no doubt a crime and that she had experienced sexual violence. On April 14, 1999, she was taken from her village and raped, but according to the panel, there was no convincing evidence, even though witnesses accused Dejanovic of taking the victim and having been uniformed. There were family and villagers. The judiciary came to the conclusion that the process of identification through photographs was by standards and this was the failure of investigators. They had to be more photos, but they had to be told the victim that the suspect could be located or not found in these photos and that it is not necessary to identify. The investigator who was present when the pictures were presented should not have known who the perpetrators were. This has influenced the liberation act, while for the second suspect the procedure was similar. Sometimes the victim in the statement mentioned that he was an old person and in some cases the age she said did not match. Once he was 5050 years old and then 6050 years old. Among the photos for the second suspect was just one of an elderly man, and others were young, and according to the judicial panel it was wrong and that according to them, she had accused Boykovic of it”, Blakaj said.
According to Blakaj, in the situation in which the case had occurred, when Krasniqi-Goodman was only 16 years old, it is normal not to have full compliance with thoughts about the age of the workers. He has said that the judicial panel had to find further evidence of the identity of the perpetrators and not make a decision by declaring them innocent.
After that ruling, the prosecution had complained, and the Court of Appeals had said the concessions were normal and small and have influenced the process of identification. Dejanovich had sentenced him to 12 years in prison, while Boykovic was sentenced to ten.
After Apel's decision, she had complained and had sought an opportunity to examine the Supreme One. The Supreme One had made the same decision as the Foundation.
“acquitted with the decision that the evidence was not convincing and that the reasoning was the same. The process of identifying perpetrators was consistent with standards. The panel in the Supreme Thinks there is no evidence beyond the allegations based on judgment. They were released and the decision was made final in 2014”, Blakaj further said.
According to Blakaj, such a decision in this case decoupled other victims. He has said that the acquittal of suspects in this case shuts the doors to other victims who have hoped in justice.
One of the suspects, Dejanovic, was part of the Kosovo Police for 16 years, while leaving the workplace in June last year. According to Blakaj, even the victim recognized him when he saw him in a police uniform.
“Victime knew he was a cop because he mentioned that after the end of the war he was at a store in Vushtrri and saw him in a police uniform and knew that this was the one who committed the” rape, he added.
