The Ministry of Management and Local Power through the Ministry of Justice, dated October 5th 2018, has announced that it has indicted the Pristina municipality, because it has not respected the orders of the Ministry of Management and Local Power, during the appointment procedure of members of the Committee for Policy and Finance.
Pristina municipality assembly decision, No. 01-020/15228/18, approved by date:18 January 2018, which had preceded the appointment of 11 members of the Committee for Policy and Finance, conflicts with the Law on Gender Equality No. 05L-20, because it has not guaranteed equal gender representation of women in this assembly's relief body.
This Pristina municipality action, following the control of MAPL's legitimacy, is found to be contrary to the legal provisions in force. This is due to the fact that, out of 11 appointed members, the Pristina municipal assembly had chosen 3 women and 8 men, which violates the criteria set out in the Law on Gender Equality that says: “Equal gender representation in all legislative, executive and judicial organs and other public institutions is achieved when a minimum representation of 50 percent (50%) is provided for each gender, including their leading and decision-making bodies”.
According to this informative letter, it is explained that the Pristina Town Convention, conform article 82.2 of Law No. 03lyL040 for Local Self-government, has undertaken no action on MAPL's request for review and harmonisation of the act with legislation in force, and therefore, the Ministry of Management and Local Power, according to Article 82 of Law No. 03/L040 for Local Self-government, has sent the act No. 01-020/15228/18 of the Pristina municipality for appointing KPF members to the competent court.
On February 7, 2018, MAPL, had sent the Pristina municipality a request for review of the act, while the Vushtria municipality's assembly had undergone no constitutional action on MAPL's request, violating the legal provisions in force.
