Zeynep's death judgment: The Court of Appeals reviews the tragedy Friday in Suhareka

The Appeals Court has seen it address complaints in the case against Zenepe Berisha's assassins Friday. In grave circumstances Zeynep had been stabbed to death by her husband, Negoti Berisha. For a 12-year prison sentence, the prosecutor and the family lawyer have sought a higher sentence, while lawyer Esat Gutaj has sought relief of the sentence.

 

In a communication with KALLXO.com, the prosecutor of the case against indictees Negoti Berisha, Mehdi Sefa, demands a harsher sentence for Zenepe Berisha's murder.

 

The Constitutional Procuror in the Nemboni Berisha case has filed complaints and sought stricter prison sentences, so we await the Court of Appeals' decision concerning our complaint”, prosecutor Sefa said. He has rejected the evaluation of the psychiatrist's expert, who had claimed that the manual had limited psychic capacity when performing the act.

 

“We don't consider that Negoti Berisha at the moment of performing has been with reduced responsibilities, as the psychiatrist expert” has considered, Sefa added.

 

And the highest sentence for Negotiate Berisha has also called for the representative of Zenepe Berisha's family, lawyer Fehmie Gashi-Bytyqi.

 

“has not been convicted in accordance with the consequences and weight of the criminal act, so I consider that my complaint will be approved and indictees Nehbi Berisha (chief of the cruel murder) will increase sentence”, said lawyer Gashi-Bytyqi for KALLXO.com.

 

And the Court of Appeals' decision is also being eagerly anticipated by the Kosovo Women's Network, which has organised a protest that will be held this Friday at 10:00 in front of the Palace of Justice.

 

The Kosovo Women's Network has extended the invitation for participation in the peaceful protest of the maximum sentence for Negoti Berisha, whom they call “the killer of domestic violence victim”.

As justice institutions were not taking appropriate measures, following numerous reactions, RGK hired lawyer Fehmije Gashi Bytyqi to represent Zeynep's family. As a result, following complaints filed by Zeynep's family representative, the Court of Appeals in Pristina has decided to hold a session Friday at 10:00.

 

Following Zeynep's murder, on the order of the Prizren Foundation Court on 12 April, the victim's killer has been sentenced to only 12 years in prison. The Republic of Kosovo's Penal Code, at Article 179 on Murder, says that “with a sentence of no less than ten (10) years in prison or life in prison is punishable by the person who:... 1.3. You deprive your family member of life”. In view of the circumstances in which this murder, the weight of the work, and the systematic violence that the victim has experienced, RGK continues to view this sentence as disproportional to the work done.

 

We remind you that in the past responsible institutions have been declared to have zero tolerance of domestic violence, but such minimum sentences are not conveying the same message. They are giving the wrong message that such greedy crimes will not be condemned.

 

Hence, RGK hopes that the Court of Appeals during this session will undertake a merit decision. RGK believes that with fair decisions, justice bodies can influence the reduction of violence, respectively. Family violence is a crime!

 

RGK and the Balkan Network for Investigative Journal (BIRN) are co-operating in monitoring relevant institutions concerning gender-based violence cases, including cases of domestic violence. This co-operation aims to raise institutional responsibility during treatment of gender-based violence, and to increase reporting these cases, ensuring that there is justice, protection and rehabilitation for cases of gender-based violence.
