Only an impartial court can enjoy the trust of parties and citizens as a whole. Thus, the 8th anniversary of the founding of the Constitutional Court of Kosovo, in which leaders of the high state institutions, prosecutors, foreign diplomatic representatives in our country participated.
Kosovo Constitutional Court Chairman Arta Rama-Hajriz said Kosovo faces challenging problems and is in an effort to strengthen the rule of law and economics.
The Constitutional Court is always in accordance with the mandate and competencies defined with the Constitution, and with other legal acts it is continuing to create its legal practice, which in some areas of constitutional rule can now be deemed freely consolidated judicial practice. It is noteworthy here that cases dubbed individual that concern themselves with the protection of fundamental rights and freedoms guaranteed with the Constitution and with the European Convention on Human Rights”, she said.
It has also spoken about that at the end of each electoral process, the Constitutional Court is seen as the arbitrator of the election results, warning that it is not good for the Constitutional Court to be perceived as determining institutions stemming from the elections, as the court does not have that role.
“is not good and it is not healthy for democracy if issues and political problems are meant to always be resolved by legal means, and as such can also become an obstacle to democratic developments”, she has said.
Rama-Hajriz has also spoken of the most important decisions the Constitutional Court has assessed during this period, as it is about Trepca and strategic investments.
It has stressed that next year the mandate of the four judges is expected to end, cautioning that if the process for their replacement is not carried out within the previous deadlines, the Constitutional Court risks losing the necessary majority of decision-making.
Kosovo President Hashim Thaci has said that implementation of the Constitution is essential for the state of Kosovo and that the Constitutional Court must continue to protect the constitutional order.
The Constitutional Court over eight years of its work has shown it is fully independent in carrying out its responsibilities in defence of constitutionality. The functioning and efficiency of the Constitutional Court should be taken as the model of functioning of the judiciary in our country and at other levels of the judiciary. Today as we are celebrating the eighth anniversary of the Constitutional Court's establishment, I would like to mention the yesterday decree of 40 judges and 13 prosecutors from non-Kosovo communities. This event marks the consolidation and strengthening of Kosovo's sovereignty and advancing implementation of all agreements drawn from the Brussels dialogue”, he has said.
Kosovo Parliament Speaker Kadri Veselini has said that the Constitutional Court has done extraordinary work during its eight years of founding, and for a few years it has achieved that others have needed decades.
“A special credit at this particular moment has our Constitutional Court in a parliamentary and liberal democracy such as Kosovo, the constitutional entity is crucial to the country's institutional and political stability. Kosovo's Constitutional Court has succeeded in fulfilling this role, and that is why it today enjoys the trust of the citizens”, Wessel has said.
Kosovo Prime Minister Ramush Haradinaj has indicated that the government he heads will help the Constitutional Court protect its constitutional norms.
Kosovo's “government will be available to help the Court on its journey to protect its constitutional norms”, he has said.
