Former Constitutional Court Judge: The mayors can address the Constitution if they are withdrawn through petition

The citizens' petition, the formula the Kosovo government has found to get out of the created situation, is seen with dilemmas by several mayors in northern municipalities. Meanwhile, former Constitutional Court Judge Kadri Kryeziu said the initiative, which is not well based on law, opens up the possibility for mayors to address the Constitutional Court in the future, where they will win the case.
To make such a petition, one must reason well on why they are leaving. They have no reason because during the exercise of their office they have committed no legal or constitutional violations. If the heads turn to constitutional, they will win the case. Administration instruction is not necessary because it is very well defined in the law on local self-government, Kryeziu said.
Researcher at the Kosovo Institute for Justice, Naim Lakaj, estimates that the Government's initiative to draft administrative instruction for organising the petition is the right move. Yes, according to him, the government is not forward to this initiative.
