The SPAK announces the official charges for Berisha, the groom and the partner:

The Special Anti-Corruption and Organised Crime Prosecutor has officially announced charges weighing on former Prime Minister Sali Berisha (with a provision of security presentation), his son-in-law, Jamarber Malltezi (with a measure of security arrest in prison) and Fatmir Bektash (with a measure of security presentation) in connection with the privatisation of the former Partizani sports club in Tirana.

The SPAK reports that former Prime Minister Sali Berisha allegedly committed the postal criminal work of “Corruption of senior state officials or local elected”, carried out in co-operation with his groom, Jamarber Malltez.

The SPAK reports that following the investigation has created reasonable doubt, based on evidence that, on Sali Berisha's side, in his quality as prime minister of the Republic of Albania, concrete and active actions have been carried out in adoption of laws or sublaws, with the aim of adapting them according to the needs presented for the five known owners, with the direct winner among others, resulting in his daughter's husband, Jamar Malltez.

In his quality as prime minister of the Republic of Albania, according to the SPAK from the EURisa “have taken active action to conduct administrative controls, with the aim of exercising pressure and providing concrete orders for the conclusion of privatisation procedures, in favour of others, even Jamarbe Malltez”.

Also, the Special Prosecutor reports that in Berisha's quality as prime minister of the Republic of Albania, “has committed active action in making available to Jamarber Malltezi, various state administration structures for realising the process of privatising state property”.

The SPAK has doubts that Jamarber Maltezi has committed the criminal establishment of “Corruption after the former prime minister's high state or local elected officers”, conducted in co-operation with former Prime Minister Sali Berisha after he deals with the latter, exploiting the powers of the former prime minister, has managed to get the irregular benefits of below<62>:

“-Privating terrain and sports facilities, with the sole goal of taking over, changing destination and using for material benefits from Jamarber Malltezi.

-The changes made regarding the destination of sports to residential areas, which has led to construction, from which Berisha's son-in-law, Mallthezi” has directly benefited, the SPAK reports.

The monetary benefits, which Malltesy received in the quality of the investor from the society “Homeplan” sh.p.k., without investing in the latter, benefits received before being declared spouseic in this society, accumulated profits over years of this society, as well as the following distributed ones, after 2018, according to the SPAK accounted for in the total amount of 672-832 Leke or 520 345 Euro.

Among other things, SPAK reports that Jamarber Malltezi allegedly appeared in co-operation with Fatmir Bektash having spent the criminal work of “cleaning up products of criminal work or criminal activity”, presenting himself as an investor in the construction of the housing block, while failing to invest, conducting financial transactions, fragmented transactions, or in cash, hiding and obtaining monetary benefits at more than 67,832 lek, or 52045 Euros (for illegal profit) as coming from legitimate investment to economic activities.

The Special Prosecutor against Corruption and Organised Crime Tirana has continued investigations into criminal prosecution no. 287 of 2020, recorded for the criminal acts of “the passive corruption of high state officials or local elected” carried out in co-operation, “active corruption of high officials or locals (4)x3> and “Cleaning products of criminal work or criminal activity”, conducted in co-operation, provided by net 260 and 25, 245 and 287 paragraphs of the Second Criminal Code.

The objective of investigating this criminal prosecution are actions carried out by top state officials and others, for the privatisation of ground and sports facilities of “Klub of Partizan football” and “Klubit Multiportis Partizani”.

Following the investigation, reasonable suspicion has been created, based on evidence that, by:

Citizens S. B., the criminal offence of “of passive corruption has been consumed by high state officials or local elected”, conducted in co-operation with citizen J. M., predicted by Article 260 and 25 of the Penal Code.

On the part of citizens S. B., in his quality as prime minister of the Republic of Albania, concrete and active actions have been carried out, in the adoption of laws or sublaws, with the aim of adopting them according to the needs of the five known owners, where the direct winner among others, resulted in his daughter's husband, citizen J. M.
On the part of citizens S. B., in his quality as prime minister of the Republic of Albania, active action has been taken to conduct administrative controls, with the aim of exercising pressure and providing concrete orders, to conclude privatisation procedures, in favour of others, even citizens J. M., his daughter's husband.
On the part of citizens S. B., in his quality as prime minister of the Republic of Albania, active action has been taken at the disposal of citizens J. M., his daughter's husband, of various state administration structures for realising the process of privatising state property.
The irregular profit in favor of citizens J. M., in the quality of the prime minister's daughter's husband, citizens S. B., there is reasonable suspicion, based on evidence, that it is:

·Private terrain and sports facilities, with the sole goal of taking possession, changing destination and using for material benefits from citizen J. M.

Changes made regarding the destination of areas from sports to residential areas, which have led to construction doings, of which the citizen J has directly benefited. M.
All the monetary benefits the citizen J has received. M. in the quality of the investor from the society “Homeplan” sh.k., without investing in the latter, profits received before being declared as a spouse in this society, accumulated profits between the years of this society and the following distributed after 2018, calculated in total on the amount of 67276832 lek, or 5 420 345 euros.
Citizens J. M. It is suspected that it has consumed the criminal work of “Corruption, since it was done in co-operation with citizen S. B., having in agreement with the latter, using the power of the former prime minister, has managed to get the irregular benefits as follows:

·Private terrain and sports facilities, with the sole goal of taking possession, changing destination and using for material benefits from citizen J. M.

Changes made regarding the destination of areas from sports to residential areas, which have led to construction doings, of which the citizen J has directly benefited. M.
All the monetary benefits the citizen J has received. M. in the quality of the investor from the society “Homeplan” sh.k., without investing in the latter, profits received before being declared as a spouse in this society, accumulated profits between the years of this society and the following distributed after 2018, calculated in total on the amount of 67276832 lek, or 5 420 345 euros.
Citizens J. M. In collaboration with citizen F. B., has consumed the criminal work of “Laundering products of criminal labour or criminal activity”, envisioned by Article 287 paragraph of the Penal Code, appearing as investors in the construction work of the housing block, while failing to invest, by conducting financial transactions, fragmented transactions, or in cases, to conceal the origin and receive monetary benefits in many 672 832 lek, or 520345 euros, (for illegal profit), by presenting it as coming legally obtained from investment in economic activities.

Citizens F. B. It is allegedly consuming the criminal work of “active corruption of top state officials”, envisioned by Article 245 of the Penal Code, since it is exactly the one that has collaborated with citizen J. M. to achieve the goal, which has been the use of sports territories for construction. Through society “Homeplane” sh.p.k. has assured citizens of J. M., providing illegal profits in the total amount of 672 976 832 lek or 5 420 345 euros.

And citizen F. B., allegedly also consumed the criminal work of “Cleaning products or criminal activity”, envisioned by Article 287 of the Criminal Code in collaboration with citizen J. M., after enabling via society “Homeplane” sh.p.k. The realization of the true origin of the irregular monetary benefits of citizens J. M., presenting them as legal income from business.

Under the investigation of this criminal proceedings, based on the 1510.23 request of the Postal Prosecutor against Corruption and Organised Crime Tirana, the First Century Court for Corruption and Organised Crime Tirana, with no verdict. 112 to 20,10,2023, has assigned these security measures:

“taskation to be submitted to judicial police”, envisioned by Article 234 of the Criminal Procedure Code and “Outbound Prevention”, envisioned by Article 233 of the Criminal Procedure Code, to citizens under investigation S. B.

Based on the 1510,2023 request of the Special Prosecutor against Corruption and Organised Crime Tirana, the First Century Special Court for Corruption and Organised Crime Tirana, with no. The 410 date 20.10.2023 has set the measure of property insurance “sequential”, for 16 (16) real estate owned by citizens J. M., 6 (six) bank accounts (in euros, dollars, and money) in the name of citizens J. M., as well as capital quotas owned by citizens J. M. In societies “Homeplane” shpk (45% of the quotas), “Megnet IMO” shpk (100% of quotas) and “MKnet Gym&Fit (60% of quotas).
