Berisha family offer: How land was transformed into millions of dollars of wealth

On June 1, 2022, Fatmir Bektash, businessman, owner or co-owner of a number of construction companies in Tirana, sent an email to his favorite swimming office. He suggested the effect of keeping accounts: “have been withdrawn from Mr. Fatmir Bektashi 637 thousand euros and paid for Mr. Malltez: paid CAS worth 547 thousand euros and 90 thousand euros in consultancy bills. ”
Keeping accounting is a routine but essential business job, only that in this case, keeping the secret was also of crucial importance. This secret, however, fell into the hands of the Special Prosecutor against Organised Crime and Corruption, SPAK, after investigators seized the computer in the Notary Office, where the accounts of Jamarber Malltes were kept.
The data helped prosecutors unlock a complicated business story through which Malltezi managed to profit at least 5.4m euros, ranging from a modest inheritance of 1/67 parts, or 113 square meters of land in total, all within a few years.
The 199-page volume file, which backed the prosecution's demand for a measure of security for Kosovazin, Berisha and businessman Fatmir Bektash, claims that the success of the goods in multiplying his property relates to former Prime Minister Berisha's willingness to change government laws or decisions, as well as its use of government structures as a means of blackmailing officials who showed doubts or resistance to Malltezi's demands.
The file also notes that Malltesy managed to gain the staggering sums not only as co-owner of the land on which palaces were built, but largely thanks to his position as a secret shareholder in the entrepreneurial company “Homeplan” with benefits of dictatorships and consultancy fees, a part of which have not been declared at Tate.
Owners and the Key to Success
According to the probe conducted by the SPAK, Maktezi is one of the heirs of the Begeva family in a property located in a former suburb of Tirana, but that has developed much after the fall of communism. In the early 1990s, they faced legal barriers imposed by the return and compensation law of property, approved by the Democratic Party's majority.
The law promised the return of property when they were free and compensation, when they were busy. To add to the trouble of landowners in question, their property was not only considered unfree for return because there were several buildings, part of the sports complex “Partizan”, but it was considered the asset of the Armed Forces.
While the owners were held in charge of recognising land ownership, the socialist government of time launched a massive privatisation campaign of so-called state companies, which were sold on the assumption that they were companies that would have to work as industry companies, but that, in fact, they were sold for ridiculous prices and buyers were evidently interested only in the value of their land. One of the assets supposed to be sold as a company was also the sports grounds of the “Partizan” club. However, sports grounds in question were not privatised by the Socialist government before 2005.
A law envisioning the delivery of sports venues with concession was adopted by the Socialist Parliament shortly before the 2005 elections and was put on hold because the Socialists were ousted from power.
Former Prime Minister Sali Berisha's government came to power in 2005. After that, land owners demanded the right to pre-purchasage facilities of Club “Partizan”, but different officials of the Magyarnica informed them that the new government had no plans for privatisation.
The situation appears to have changed from January 2006 to later, when some of the landowners chose Jamarber Malltez as their representative.
They even signed contracts to recognise him from each of them's tax properties, a quota of 3-5% “for expenses”. Problems, which looked like on the impregnable wall of bureaucracy and lack of will on the part of government officials, began to reach solutions. And the first success seems to have come from less expected. According to the prosecution, Tirana City Hall, on June 8th 2006, a few months after owners had appointed representatives of Malltez and signed an entrepreneurship contract with the contact company, decided to re-classify property from sports ground to construction grounds. The prosecution notes that the municipal decision to change the destination of using property appears to be not allowed by the urban law.

While the name of Mayor Tirana's head is missing in the decision, it is said that this change was confirmed at the National Council of Territorial Regulatory, whose chairman at the time was citizen Sali Berisha.
Berisha used this fact to illustrate his argument that the charges are politically motivated, adding that the Earth's destination has been changed by Rama.
Asked by BIRN on Berisha's charges concerning Rama's role in the issue, SPAK said that “does not comment on the subject' statements under investigation”.
The prime minister's press office did not answer BIRN's questions until the publication of this letter.
Texted Laws
Although state institutions began to respond best after representing owners from Malltezi, laws imposed just by the Democratic Party in the early years of HINA90s seem to have made obstacles to taking on land again extraordinary. According to SPAK, Berisha was willing to make the necessary legal changes, which in the final instance served his groom's financial interests.
In June 2008, the Council of Ministers proposes changes to the Law on Sports in parliament, predicting that, “terrent sports can be privatised by landowners.” The prosecution notes how, very ironicly, the accompanying legal change statement suggests that the change is “in accordance with government policy, sports development, quality service growth, the achievement of high levels in sports”... while the final result seemed not to have anything to do with sports but construction.
The prosecution notes that as the Council of Ministers proposed the legal change, the procedures for privatisation move rapidly. The privatisation property included not only 2.2 hectares of property owned but also 0.42 hectares of our state owned.
In December 2008, the Council of Ministers, led by Sali Berisha, makes another decision, under which state properties were privatised by paying 20% on money and 80% on privatisation bonds. Consequently, the state share of land in question was privatised at a substantically lower price, because privatisation bonds -- documents originally issued in 1996 -- are worth as much as 3 or 5% of nominal value.
At the meeting of the Ministers' Council where this change was discussed, Berisha welcomed the then-Prime Minister Ruli's proposal for the inclusion of letters worth in privatisation for former owners.
“Bravo, give this announcement, that this too constitutes innovation,”, Berisha was quoted.
We owe the valuables that we haven't distributed, we need to find ways to help them, to remove these valuable letters,” he adds.

By 2018, the company “Homeplan”, which built the towers, resulted in 100% ownership of Fatmir Bektash. He signs all decisions on behalf of the shareholder and attracts the dictators. The prosecution notes how in communications seized in the notary office, the terms “consensual payment” and “divident” are used in a mixed way with each other. According to the prosecution, this “maintains the reasonable suspicion that, in order to take over this citizen, of the benefits of the Homeplan society, despite having not been legally a partner of this society. ”
The prosecution also notes that in company documents, the amount of thousands or tens of thousands of euros is paid to Malltes, identifying it only with initials, as well as “occasionally even with the words “KP” or “Patriotic Contribut”.” According to one of the witnesses questioned by the prosecution, it was not clear why the term “contributant patriotic <xx7> was used, but it was also evident that the term was used for payments to Malltez by Fatmir Bektash.
For unknown reasons, the partners decided to make a new contract in 2014, which they officially deposited at the National Business Center in 2018. In the contract, national Fatmir Bektash sells shares on the nominal value of $350,000 with his wife's consent.
The prosecution notes anomalies: By the end of 2013, the company had indiscriminate profits of $362 million. With many construction towers under way, the sale of 35% of its shares for $350,000 looks like a peace deal. In fact, the prosecution suspects that the transaction has served as a way of justifying the transfer of money from the company to Malltesy, who has already been a shadow shareholder, although there is no data to suggest he invested money in the company.
Such a fact has been admitted to the prosecutor as well by Fatmir Bektash, who said Malltezi has always been part of the society “Homeplan”, “regardless of when things are reflected at the National Business Centre”.

Berisha, who has spoken extensively on charges over the past few days, has given a number of arguments as to why the charge against him is unfounded in the law.
