Under the indictment, Ismajli and Gashi are also obliged to pay court expenses, 100 euros per judiciary pause and 50 euros for compensation of crime victims.

According to the indictment filed on 4 March 2020 by the Special Prosecutor of the Republic of Kosovo (PSRK), Rafet Ismaili in the quality of Basic Court General Department judge in Mitrovica, the Skenderaj branch and B branch in the quality of the police official have committed criminal work “

But, the Court of Appeals of Kosovo on April 22, 2021, following the complaint, the first degree ruling had annulled it and the case had turned into retrial, due to essential violations of the procedure's provisions, wrong and incomplete confirmation of the actual situation, violation of criminal law and the sentence.

The Special Prosecutor of the Republic of Kosovo, on 4 March 2020, had filed charges against Rafet Ismajli, the judge of the Department of the Constitutional Court in Mitrovica, the branch in Skenderaj and Blerim Gashi, police official.

According to the indictment, Ismajli has directly accepted rich benefits, with the claim that the same is able to exercise unjust influence on the official person's decision making.

Also, according to the indictment, the same thing on August 28, 2019, in witness F.Z.'s car, as they were moving together from Skenderaj to Pristina, has received from witnesses the money in much of a thousand and 500 euros, in order to exercise unjust influence on the head of the Constitutional Court in Mitrovica, to make a decision to postpone the execution of the prison sentence, pronounced in the act of precipitous form of the Constitutional Court in Mitrovica, 26 July 2018 to the witness of 4 months in length, and the same effect on the Supreme Court for the destruction of Kosovo's Supreme Court on high court, with the judicial law enforcement.

While according to the prosecution, Blerim Gashi, in the quality of the official person, the police officer in the Kosovo police, has directly acknowledged wealth gain, with the claim that the same is able to exercise unjust influence over the decision on the official person's decision, so that the same on August 28, 2019, in the F.Z. witness's car, in Fushe Kosovo, has received from the witness of the outstanding amount of money at many thousand euros in order to influence the judges of the Supreme Court of Kosovo for breaking the court form of the Constitutional Court in Mitrovica, July 26, 1818, with the request for judicial protection of the court, whose sentence was pronounced by the 4 months in prison.
