Serbian judges and administrative staff have submitted their resignations to the Constitutional Court in Mitrovica on Monday.
Linked to these failures, the noted lawyer, Arber Jashari, has said the resignation of judges and prosecutors will have serious consequences in the judicial system.
He has said that even their return will be impossible, as the opening and recruiting of the contest are needed.
“will have consequences of exiting officials from the Serb community from the institution of the Republic of Kosovo, but the consequences in the judicial system will be enormous. Since there are procedures to return to institutions, there can be no other way but to start over, so recruiting as in any case, and their organised return” will be impossible, Jashar said.
He has said that with the failure of hearings, many subjects will be obsolete and will not receive judicial epilogue.
“The consequences are enormous, especially in court cases, with many court hearings postponed, and perhaps some subjects will wear out and not receive judicial epilogue. Then these judges and prosecutors who have resigned will have a tremendous lack of them, and regardless of how politicians agree, their return cannot be the way they came out, but he must start from the beginning, respecting all competition procedures, recruiting, as for all other citizens, shit this will take a lot of”, Jashar told EO.
While talking about the resignation of these judicial officials, Jashari said their absence would be seen in Albanian majority municipalities, as the same have held sessions in Skenderaj and Vushtrri.
The “following the Brussels agreement is meant to have 9 Serbian prosecutors and 9 Albanian prosecutors at the Constitutional Prosecutorship in Mitrovica. I know that Serbian prosecutors, regardless of ethnicity, have conducted sessions in other municipalities, such as Skenderaj, Vushtrri and Serb majority municipalities, and their absence will reflect on Albanian majority municipalities”, Jashar said.
