Contacted by Radio Free Europe, Sheremet says that recently, his son, Debrani, has been ill with COVID-19. He was identified for 14 days, until Thursday, September 2nd, when he had passed the test and had resulted negative in COVID-19.

Kosovo Minister of Internal Affairs Jedal Svecla on Monday, August 31st, has declared that Kosovo's “police will take control of persons who are on the list of the National Institute of Public Health, as infected, to make sure that those who do not need medical treatment are self-aware in their homes and, as well, those who return to Kosovo and sign under a declaration for vetoation, make sure that they abide by this constitutional <186>.

But, Sheremet Dan says that neither before the Internal Affairs Ministry's decision to verify self-inflicted persons because of infection, nor after that decision, did his son visit or call. According to him, despite his son's identity, neither police nor health institutions had verified this fact

Nobody called... nobody at all. Neither the police nor these health care guys have come to ask if you're better, do you need any help? But after he (his son) performed 13 days in proselytizing on the 14th day, he said he would go and test the state institution here. He took the test and got negative”, Sheremet Dan said.

Radio Free Europe has also contacted other people infected by the Coronavirus, who are in proselytized, but they have not wanted to talk about whether they have had police or not.

Kosovo Police officials have stated that police have enough capacity to implement the Kosovo Ministry of Internal Affairs's decision to supervise persons infected with COVID-19 and that they are identified in their homes.

With the Kosovo Government ruling, the Kosovo Police's work schedule has lasted from 8 to 12 hours.

Kosovo police, through a post in its official Facebook account on August 31st, have said that “has engaged police officials in civilian clothing on the ground who operate at the country's” level to take care of the implementation and respect of the measures, including the use of masks on the part of citizens, as well as the “rescriptation of the measure for personal possession that sign the declaration for self-esteem”.

The same day, Kosovo Police spokesman Baki Kelani has told Radio Free Europe, that police have sufficient capacities for implementing the measure of control of self-owned persons.

The “currently is, because we are on a 12-hour schedule (work) and the police personnel' commitment is in greater number. So we are able to accomplish the tasks that have been defined”, Kelani said.

He did not want to comment on the details about whether the provision of surveillance of infected persons with the COVIID-19 will be implemented, which are identified in their homes, through police visits to those homes, through telephone calls, or in some other form.

On September 3rd, Kosovo Police for the South Mitrovica region, through a media communique, have announced that police officials have intensified the commitment to search for persons with the move <x0.>

“Controls are being implemented by uniformed police officials and civil clothes, with the aim of verifying that the measures prescribed for the individuals in the proselytisation be in line with the set deadline by the competent institution”, the Kosovo Police Community says.

Ibishi: Superigned police, wrong approach.

Security Affairs Knower Nuredin Ibishi, speaking of Radio Free Europe, says that practices when police monitor self-owned persons exist, though, according to him not many. But, according to him, the police's commitment to monitoring individual identity is the wrong approach by government institutions.

He estimates that the police's commitment to monitor the cases of self-inflictedness due to infection with COVID-19 may leave the debate over its commitment to secure the country and prevent criminality.

Ibishi expresses the opinion that Kosovo Police have been charged with tasks that are not at all in its mandate. As he says, police should deal with the assistance of institutions, in this case health inspections, which, according to him, should pronounce the measures.

Police, instead of dealing with assistance, with measures that ensure the implementation of a service in this case, health, for which the inspector is obliged to pay the fine or oversee the police are taking that role. This is totally incomprehensible. We, the police, we've gone too far. Police, engaging in secondary tasks, which at times are not in its mandate, are leaving a very important task in preventing and combating rivalry, which is worrying”, Ibishi said.

Shala: Police have legal mandate to implement anti-convictive measures

Justice Institute lawyer Gzim Shala points out that the Law for Prevention and Combating of COVID-19, which was adopted in August last year by the Assembly of Kosovo, gives the country's government the right to take all necessary measures to prevent and combat pandemic, including implementation of its decisions by police.

In a conversation with Radio Free Europe, Shala emphasises that according to the law, Kosovo Police are the institution that has a mandate to monitor the implementation of measures defined by the Government of Kosovo, including the north of persons identified due to COVID-19.

“Article 23 of the Law for Prevention of COVID-19 says implementation of all measures defined by this law provides Kosovo Police and other relevant inspectorates. So, in terms of monitoring these measures, the important thing is that together, each institution, can exercise its authorization to monitor the implementation of anti-convid measures, defined by the government under decision”, Shala said.

Early last summer, the Constitutional Court had asked the assembly to provide legal grounds so that other bodies could carry out their work on preventing and fighting pandemic without violating the law.

Shala said that since the adoption of the anti-David Law in August last year, it is considered that the Government of Kosovo, according to the legal basis and in accordance with the rules specified by the Constitutional Court, when it imposed restrictions on human rights, it has acted under Article 55 of the Constitution. In line with this article, under legislation in force and rules that the Constitutional Court has established, Shala said the government is not committing human rights violations. / REL
