Isa Mustafa: Why the VV is not operating for the Zajednica demarcation because it has votes

European Union for Foreign Policy representative Josep Borrell, and Kosovo Prime Minister Albin Kurti have clashed over the issue of establishing the Association of Serbian municipalities. Borrell said he would constantly seek the implementation of Association, while Kurti said this agreement has not passed the Constitutional Court test.
These positions have been commented on by former Kosovo Prime Minister Isa Mustafa.
Mustafa has declared that when he was prime minister, he has made written pledges from the European Commission that association has no executive competence and is not the third power.
“As Prime Minister in 2015, I have received a written pledge from European Commission Vice President Mrs. Mogerhini that association according to EU views has no executive competence and is not the third power. While the Law for ratification of the First Agreement is in force, Kosovo is obliged to establish (but without executive competence). That's what the Constitutional Court has said”, Mustafa told Express.
Mustafa says Kosovo should create the Association of Serbian municipalities based on the Constitutional Court's agreement that it will not have executive competencies.
The former head of the LDK states that an association with constitutional changes the EU Special Envoy for Kosovo-Serbia dialogue Miroslav Lajcak has spoken about would be unacceptable to Kosovo.
The Constitutional Court has ruled that association must be established under the First Agreement, reached in 2013 and ratified by the Law from the Parliament. The court has found that association has become part of Kosovo's judicial order. I always remember that the Court refers to an association that has no executive power and that is not the third power. Not for association with constitutional changes that Mr. Lajcak. Such association has never been discussed and it would be unacceptable to Kosovo”, Mustafa has declared.
Kosovo's former prime minister says that if Serbia and the European Union require that the association receive competencies of municipalities through constitutional changes, Kosovo should withdraw.
He says that in no case, Kosovo has taken no obligation for constitutional changes, to create space for the Association, which Serbia prefers.
Mustafa says Serbia was hired six years ago for the Association to be established, when the Constitutional Court found its status in full accordance with the Constitution of Kosovo.
“It should be commemorated that in 2015 Serbia had agreed that the association will be considered established when the Constitutional Court of Kosovo states that its statue is in line with the Constitution of Kosovo”, Mustafa has declared.
Mustafa has also cited Prime Minister Albin Kurti's stance and his party for Association, when they were in opposition.
He says Kurt and the V's now in power should act and take responsibility.
“As far as Prime Minister Kurti is concerned, he and his party have opposed Zajednica by all means. Now they are in power, they have large numbers of MPs, now they don't need to do opposition, but to act and take responsibility from the” position, Mustafa has declared.
Mustafa also says that if Kurti and his party have arguments that Kosovo has lost 8 thousand and 200 hectares in border correction with Montenegro, why are they returning it to Kosovo.
He claims the position has votes for these two agreements.
The same goes for the border with Montenegro. If even today they think and have arguments that Kosovo has lost 8,200 hectares, why we are not acting to correct and return Kosovo. Votes are also due to Zajednica for border agreement with Montenegro. They have those with whom they have elected President”, Mustafa has declared.
Otherwise, on 25 August 2015, the Kosovo delegation led by Prime Minister Isa Mustafa has signed four agreements with Serbia, among which was the Serb majority municipalities.
The current prime minister's party, Albin Kurti, the Vetevendosje Movement, had consistently rejected association, calling it Serbian “Zajednica”.
