Gucati's lawyer, Jonathan Elystan Rees, has started defence with Kosovo's presentation as a sovereign and independent state, which, as such, must act and respect the right to free speech.
He has said justice should be offered to all, and not only to some, as he spoke of the work of the Special Court and the opposition former KLA OVL leaders had done to her.
“Under the law this institution is an institution of the independent and sovereign Republic of Kosovo, it is fair that the people of Kosovo act as such. The modern Republic of Kosovo places the highest value on freedom of expression and opinion. These freedoms were won by the Hysni Gucati generation by sacrificing their lives and blood”, he said.
He added that “in support of recognition of this sacrifice, the Republic of Kosovo requires its institutions to be open and transparent, for the light ray to shine on all corners of administrative and judicial bodies”.
The information classification law is clear, not to be used as an instrument to conceal violations of the law, duty abuse, inefficiency or error. It should not be used to prevent a person or an organization from harming. We're looking to check what is done by the work of the suspected persons by giving only diagnosed versions of the public. The present and the future of Kosovo should be a reality where justice is offered for all and not just for some”, he has said.
Rees has said that Gucati has expressed concerns concerning the Special Court, but that according to him, his speech has been turned against by the specialised prosecutor who has labeled Gucati as the subject of harsh expression against the institution.
A saying that the Gushati used is that the ZPS does not follow justice for all but for a few. The prosecutor's claim specialising in the opening statement that this court should be one that is driven by the victims is violated by the actions of its office, which follows not the path of anyone who may have evidence of criminals but his mandate.
