In 2016, Kosovo's Constitutional Court has ruled in favour of the Decani Monastery, but it has not been implemented, although the Constitutional Court's decisions are final and binding on all sides.
For years now, the international community has called on Kosovo institutions to implement this Constitutional Court decision and allow the Monastery to register land in the cadastra.
The Decani Monastery also has a dispute with local authorities in Decani, which has to do with the construction of the main Decani Street Plav.
Works for the construction of this road are under way through the protection zone of the monasteries, and they have been interrupted several times at the request of the Government of Kosovo or the international community.

Kosovo's Constitutional Court issues the verdict that the Decani Monastery is the owner of 24 hectares of land and forest. It rejects the Kosovo Supreme Court Special Chamber of Appeals College's decision in 2015 to return the course to the Constitutional Court in Decani. The Constitutional Court also stipulates that the previous Supreme Court ruling from 2012, which confirmed the right to ownership of the Monastery on Land in Conflict, is “res Judicata” (powerful ruling).

Social companies “Apico” and “Iliria” apply to the Constitutional Court of Kosovo for the assessment of “legality and constitutionality”, respectively, for “anulim” and “revoting” of the Constitutional Court decision that the Decani Monastery is the owner of 24 hectares and forests. They claim the decision is “illegal and unconstitutional”.

Historians and local authorities in Decani hold protests against the Constitutional Court's decision, which confirmed that the Decani Monastery is the owner of 24 hectares of land and forest. They consider the property belongs to social companies “Apico” and “iliria”, that it was never of the monastery, and that the Constitutional Court legalised Slobodan Milosevic's decision from 1997, when it decided to donate property to the monasteries. At the same time, the Serbian Orthodox Church has voiced hope that the Constitutional Court's decision will be respected.

The Constitutional Court of Kosovo issues “The Decision for Unacceptability” regarding the requirements for the assessment of “legality and constitutionality”, which have been submitted by social companies “Apico” and “The Constitutional Court stresses that “such judicial action is not allowed or authorized in any way, with no provision of the Constitution, Law or Labour Order”. It is estimated that the Constitutional Court cannot assess, abolish, review and revote its final decisions.

The European Union expresses concern that the Constitutional Court's decision regarding the ownership of the Decani Monastery is not being implemented. On the other hand, the Kosovo Historians' Association, the Decan branch, gives the ultimatum to the Government of Kosovo until April 21st to be included in resolving this issue, on the contrary, in light of dissatisfaction with the work of local institutions, will block the road leading to Manastir. The Kosovo government orders that the Constitutional Court's decision should be implemented and that there is no going back.

In his letter to Igumen of the Decani Monastery, he expresses his desire to visit the monastery. From the Diocesa of Raska and Prizren of the Serbian Orthodox Church, they say the talks can only be held when the Constitutional Court's decision by 2016 is implemented, under which 24 hectares of land belong to the Decani Monastery.

Kosovo's Constitutional Court issues the “Decision for non-execution of the verdict”, where it says its 2016 ruling has not been executed. The decision is that the Decani Monastery is the owner of over 24 hectares of land and forest. In that decision, the Constitutional Court stresses that it has no jurisdiction to assess responsibility for the non-execution of a Court decision by responsible bodies, but that such an assessment belongs to the State Prosecutor, in accordance with the Criminal Code and the Criminal Procedure Code of the Republic of Kosovo.

The rapporteur for Kosovo in the European Parliament, Violet Von Crammon, says that “tolerance and mutual respect are the essence of a multiethnic society”. Through a post in its Twitter account, it calls on the Government of Kosovo to implement the Constitutional Court's decision because “sundation of the law means equal treatment of all”.

Germany's ambassador to Kosovo, Jorn Rohde, writes in his Twitter account that it fully agrees with the declaration that implementation of the Kosovo Constitutional Court's decision from 2016 is being delayed. “The arbitrary implementation of the rule of law is not the way ahead of”, writes Rohde, responding in the statement published by Violet Von Cremon, reporting on Kosovo in the European Parliament.

The Quint States voice their concern over the failure to implement the decision on the land of the Decani Monastery, saying that disrespecting the Constitutional Court ruling undermines the Kosovo Government's pledge to implement rule of law and respect the independent judiciary.
