Skender Hyseni has reacted to Borelli's statement yesterday. The former Kosovo negotiator and top diplomat has compared his statement to an example in football.
According to Hyseni, Borelli's statement was like a penal reference against Kosovo, 25m from the gate, in the ninety-minute game.
“Borelli, with its meaningless statement about the operational actions of Kosovo's rights bodies in the north, knowingly or unaware, was put to the defense of crime in a part of our country.
Totally unacceptable, this statement was like “a penal reference against Kosovo, 25m from the gate, in the ninety-minute game”.
The fundamental question to be stretched here is whether Borell has credibility to be an impartial mediator in Kosovo-Serbia dialogue. After yesterday's statement this dilemma gets even bigger. However, earlier than by us, respectively, from the Kosovo government, this question should be posed by President Biden, President Macron, Chancellor Merkel, Prime Minister Johnson, and senior EU officials, because Kosovo does not have the power of influence and even less of the decision-making in the matter.
Borell cannot behave as if he were a prosecutor or a police commander in Kosovo. With yesterday's statement, being on the side of the crime, Borell stepped on one of the EU's founding values for law order. He needs to know that law and law bodies in Kosovo are sovereign and should not take advantage of anyone to fight crime on its territory. The less Serbia's approval, which is, in fact, the main criminal sponsorship in a part of our country.
The Kosovo government and justice bodies are and should be completely sovereign in its operational actions against crime. At the same time, she, the government of Kosovo, must be careful and open-eye and not allow an accompliʹ phiati accompli that Serbia wants so much, and why not, even part of the international community.
Kosovo dialogue ʹ Serbia must conclude with an inclusive, legally binding agreement, for normalisation and mutual recognition on existing borders. The primary goal should be to open the road to integration of both Kosovo and Serbia into the EU as two independent states.
So, the crucial issue between Kosovo and Serbia must be addressed without delay.
However, I appreciate that any options promoting ideas about partitioning Kosovo, or any exchange parties, affecting the current borders of the Republic of Kosovo are unacceptable and dangerous. Kosovo is a multiethnic state, of all ethnic communities living in it.
“Status-Quo” is not to be liked by Kosovo because it goes against its own interests, while it is Serbia who likes the status quo, pending some miracle in the form of an environment and the political context appropriate for imposing its political and territorial claims on Kosovo.
For Kosovo, the final solution to the historical and political conflict with Serbia, which is essentially a conflict between Albanians and Sebrees, is vital.
The Kosovo context, Serbia, does not tolerate preferential solutions. The Kosovo government should not implement any preferential agreements or solutions. Thus, a comprehensive, legally binding agreement, for normalisation and mutual recognition, is necessary so that these two countries can implement preferential agreements on specific issues.
So dialogue must continue and close with full recognition of the state of Kosovo from Serbia.
The Intercommunicative Court of Justice, with a convincing decision, has concluded on July 22nd 2010, that Kosovo's declaration of independence has not violated any applicable International Law rate. So Kosovo is an independent state within its existing borders. This is an irreversible and non-negotiable political reality. Therefore, whatever contribution and assistance to achieving Kosovo-Serbia's mutual recognition, which teaches serious concern, must be built on this final prememinence” is said to be in Skender Hysen's response.
