Director Samedin Mehmeti must clear up police capacities to ensure if, for any of the accused, the house arrest measure is established.
While the decision was translated on 13 October, police have not yet returned to Judge Nicolas Giju.
This is confirmed for RTK from Special Court.
Kosovo's “Policy has been given two weeks since the Albanian translation notice of the Order to respond to the judge of the preliminary procedure. All public files are available on the Special Court website. Any subject or person in Kosovo should co-operate with the Specialised Chambers and be reconciled without delay at any request”, the Special response reported.
Even after eight days, Kosovo police have not responded to RTK's interest in the issue. In brief, they have demanded that television be referred to the declaration of director Samedin Mehmeti, given weeks ago to the Parliamentary Commission for Security. But there, he has refused to answer clearly.
We have had requests from lawyers, and have responded that we have capacities for each decision. For the Special Chambers, they asked you to spare us, and to ask the court”, Mehmeti said at the October 12th meeting.
For lawyers in Kosovo, police are obliged to provide clarification to the Special Court.
“In the Law for Special Court it is envisioned that all institutions in Kosovo, including the Police, are obliged to respond to Special Court or Specialised Chambers”, says lawyer Skender Musa.
Even if there are no answers from the police, other measures may be taken.
I believe that police within the legal deadline will respond, otherwise I can repeat the order, but there may also be other legal consequences for official persons who fail to comply with court orders”, Musa says.
The order to seek clarification by Kosovo Police, the judge has taken it from a decision by the Court of Appeals at The Hague.
Police should offer concrete answers about measures they can implement for parole, monitoring communications and managing house arrest for those accused by the Special Court.
