Such a statement, Recica has given it at Thursday's session at the Constitutional Court in Pristina, in the trial where former Vetevendosje President Driton Caushi is accused of throwing tear gas in the Assembly and prevented the chairman of the Parliament and MPs from performing official duties, reports “Bettim for Justice”.

“I just don't remember who threw tear gas, I just know that there's a quick reaction, there's smoke in the smoke, we voted on the issue that the communicon was gathered for, and then we got out very quickly because it was impossible to stand in the room where the meeting of this” commission was held, Recica said.

Responding to prosecutor Besart Musatafa's questions, witness Recica said on August 9th 2016 had participated in the assembly of the Foreign Political Commission held in the Kosovo Assembly, as the same was chairman of this commission.

He has said he remembers that tear gas was dropped at that meeting to prevent the development of that meeting.

And for the accused Chaushi has said he cannot remember the same had participated in this commission, since Chaushi was not a member of this commission, according to him.

As far as I recall, the then deputy was not part of the commissary, as I remember”, said Recica.

In this regard, prosecutor Mustafa has announced the witness that the accused had been at that meeting and that the videos are for that.

Recica has stated that by regulations it has been possible for other MPs to participate in these meetings and MPs who are not members of the commission, but the same have been able to sit further away from members of the commission.

In the end, Recica added that while he was in this position, this was the only case when tear gas was poured out, while according to him in the plenary session hall there are dozens of times of tear gas drop.

On the other hand, the hearing has continued with the handing over of defenders of accused Caushi, who has used his right to defend himself quietly.

“I prefer to defend myself quietly, I stand behind my plea about guilt because I don't know myself guilty”, said accused Caushi.

Following the defendant's statement about his defence, the final word was given by prosecutor Mustafa, who the judge has proposed that Caush plead guilty and condemn him by law, as well as take into account the circumstance that Caushi criminal acts committed for the purposes of political discontent rather than personal motives.

Prosecutor Mustafa stated that during this trial following witness hearing, and particularly witness Recica, the management of evidence and video-incistation has proved beyond well-based suspicion that the defendant Caushi has committed criminal acts that are placed on him.

Also in his final address, prosecutor Mustafa has made the accuracy of the indictment so that instead of August 10, 2016, he must be August 9, 2021, 11:55, as well as add the word “deliberately”.

Likewise, prosecutor Mustafa has made the precision of the indictment since according to him at the official “section, witnesses Kadri Veselini, Adem Grabovci, Ismet Beqiri, Sabri Hamiti etc, must be deputies of the Kosovo Republic's Foreign Policy Commission.

The announcement of the indictment on this criminal case will take place on 12 October 2021.

In contrast, Pristina's Constitutional Prosecutorship on March 27, 2018 has filed an indictment against Driton Chausch, where it says on August 10th 2016, during the meeting at the Assembly Hall of the Republic of Kosovo, where the accused was involved in the quality of the Vetvendosje Movement MP, has thrown tear gas into this hall, with what has come up against Article 9.1 of the No.04/12 Peace Rule in the Republic of Kosovo, where weapons use is banned.

With these actions, the prosecution charges him with the criminal act “the use of weapons or dangerous means” by Article 375, paragraph 1 of the Criminal Code, which is sentenced to imprisonment of one to eight years.

The prosecution also charges Chow with criminal activity “preventing the official person from performing official duties” from Article 409, paragraph 1 of the Penal Code, which is sentenced to prison for three months to three years.

According to the indictment, the accused Caushi at the site and high-time, during the use of tear gas has prevented official witness Kadri Veselini, in the quality of Kosovo Assembly Chairman and witnesses Adem Grabovci, Ismet Beqiri, Sabri Hamiti, etc, from performing official duties, with all official persons forced to interrupt the meeting and leave the hall.
